Introduction
This report covers an appeal by Council Member Ruth Yannatta
Goldway from the decision of the Planning Commission allowing
development of a commercial storage and office building in an
R3 District.
Background
The applicants own and operate an automobile top and upholstery
business on three lots at the northeast corner of Lincoln Blvd.
and Broadway. They also own two R3 lots at 1438-1446 - 9th Street
which are partially in use for parking and until February for
residential purposes. The property immediately to the south
is commercially zoned and developed with an office building, a
retail gardening supply business and exterior storage. The pro-
perty immediately to the north is developed with 10 older units
on two lots while property on the easterly side of 9th Street is
developed with multiple residential units in good condition.
The applicants propose to erect a two story structure with sub-
terranean parking. The first floor would be used for storage
in connection with their automobile upholstery business and the
second floor would be offices. The Code requirement of 42

The building

Under Section 9148 of the Zoning Ordinance, the Planning Com-
mission or City Council may permit the establishment of commercial
uses within a multiple residential district. The Council must
find the proposed use and location are in accordance with good
zoning practice; in the public interest; and necessary. The
Council may require such conditions as are necessary to insure
the use is compatible with existing and potential uses within
the general area; traffic or parking congestion will not result;
public health, safety and general welfare are protected and no
harm to adjacent property will result.
On June 18, 1979 the Planning Commission found that the applica-
tion met the requirements of Section 9148 and provides a good
transition between the active commercial areas of Lincoln and
Broadway and the residential uses on 9th Street and would help
shield the residential uses from the alley and activities areas.
The building was required to provide front and side yards simi-
lar to those required for a residential structure, have no commer-
cial signing and present a reasonable appearance of a residential
building.

Alternatives
Under Section 9148C the. City Council may affirm, reverse or
modify ang determination of the Planning Commission in a matter
of a Conditional Use Permit. The Council may therefore grant
the appeal and reverse the .Planning. Commission's decision, or
deny the appeal and allow the Planning Commission's action to
stand, adding whatever additional conditions or requirements
believed necessary.
Recommendation
In view of the Planning Commission's evaluation and findings,
it is respectfully recommended .that the appeal be denied and
the determination of the Planning Commission affirmed.

Commissioner Sullivan moved for approval of the Tentative Map and Condominium Permit

6. OLD BUSINESS:
A. Conditional Use Permit No. 277 U P
The staff report was read for a Conditional Use Permit requested by John S. and
Richard D. Robbins to permit commercial use in a residential district. The matter
had been continued from the May 21 meeting for submission of elevations and clari~.fi-
cation of parking spaces. Mr. Lunsford noted two letters received in opposition
from:- Rose Seigol, 1433 Ninth Street, and Kenneth Arrick, Arrick Chevrolet, 900
Santa Monica Boulevard.
Following discussion Commissioner Sullivan moved for approval of the revised project
subject to the staff recommendations noted in the May 21, 1979 staff report.
Seconded by Commissioner Kleffel the motion carried as follows:

6. Tentative Tract Map No. 36630
The staff report concerned a new six-unit condominium proposed by Gwo Rong Ueng
at 1031 Eighteenth Street which had been redesigned to incorporate an existing tree
into the landscaping as required by the City Council. Mr. Lunsford circulated photo-
graphs of the tree and noted receipt of a communication from Concerned Citizens of
18th Street. Emery 4long responded to questions from the Commission. Commissioner
Kleffel moved to approve the Tentative Map and Condominium Permit subject to compli-
ance with Revision Three plans and alt staff recommendations with the added condition
that the limbs of the Pittosporum Undulatum be tied back in such a manner that the
tree is not damaged during construction. Seconded by Commissioner Hotchkiss, the
motion carried unanimously by vote of the six members present.
C. Tentative Tract Map No 36606 and Z A Case No 4036 Y
The staff report noted that this new six-unit condominium project at 1128 Fif-
teenth Street proposed by Frank Liu of Wellesley III Ltd. had been considered at the
June 4 meeting and continued for revised parking plans and all-around design. Com-
missioner Sullivan moved for approval of the Tentative Map and Condominium Permit
subject to all original staff recommendations being complied with. The motion was
secpnded by Commissioner Kleffel, and carried by a unanimous vote of the six
members present. Mr. Lunsford noted that the palm trees would be retained.

The staff report requested reconsideration of a proposed amendment to the Code

SECTION 1. An application for a Conditional Use Permit to permit
commercial use in a residential district having been filed by
John and Richard Robbins on March 30, 1979 and a public hearing
having been held on May 21, 1979 in accordance with the provisions
of Section 9148 of Chapter 1, Article IX of the Santa Monica
Municipal Code, the City Planning Commission hereby finds as
follows:
1. The property proposed for commercial use legally
described as lots H and I, Block 166, Town of Santa
Monica is contiguous with and immediately adjoins an
established C4 Commercial District on the northwest
corner of 9th Street and Broadway.
2. .The uses proposed consisting of offices and storage
are uses permitted in the adjoining established commer-
cial district.
3. The proposed use and location are in accordance with
good zoning practice, in the public interest and neces-
sary in order that substantial justice be done in that
the property is immediately adjacent to the rear of a
commercial office building and a hardware and garden
supply business and immediately across the alley from the
rear of commercial buildings fronting on Lincoln Boule-
vard.
4. The proposed use is compatible with existing and po-
tential uses within the general area in that the property

SECTION 2. The Planning Commission, therefore, determines that
a Conditional Use Permit should issue for the use of lots H and
I of Block 16b, Town of Santa Monica, commonly known as 1438-
1446 - 9th Street in the City of Santa Monica to permit the de-
velopment of a commercial building: for office and storage uses
on the following conditions:
1. That construction shall be in substantial accordance
with the plans submitted as part of the application except
that the front set back shall be not less than 15'.
2, That the front and side of the building shall be ap-
proved by the Architectural Review Board, shall be devoid
of any commercial signing other than an address, all
idehtification or directories to be confined to the
interior of the lobby, the 'front and side of the exterior
of building to present a reasonable appearance of a resi-
dential building.
3. That the large, street palm tree on the southern most
boundary shall be maintained and substantial landscaping
installed and maintained subject to approval of the Archi-
tectural Review Board.
4, That the first floor area shall_be used for storage
only, the remainder of the building to be limited to office
uses and no restaurant, entertainment, manufacturing or
other such uses and are to be at all times conducted in a
manner not detrimental to surrounding properties by reason
of noise, lights, appearance or other activities.
5. That the rights granted hereunder shall be exercised
within one year from the effective. date of this permit
and that any violation of the conditions imposed shall
render the permit null and void and subject to revocation.

SECTION 3, The Chairman Pro Tem is authorized to execute these

The staff report concerned a request by John and Richard Robbins to construct
a two-story storeroom and office building over a subterranean garage for thirty-four
parking spaces at 1438-1446 Ninth Street on R3 property. Commissioner Katz noted
receiving a call from f^r. Simpson, 1455 Ninth Street, in opposition to the proposal,
who stated an earlier use of the property for parking. h1r. Lur.sford recommended
further' study to clarify the matter. Discussion also spoke to use of sewing machines
on the premises. John and Richard Robbins addressed the Commission and stated it was
not ti~eir intent to use the property for manufacturing and avould prefer a ten foot
setback rather than a fifteen foot setback.
Commissioner Kennedy moved to continue the item for two weeks to permit study of
previous parking allocation and with the request that copies of proposed elevations
be submitted. Seconded by Commissioner Kleffel, the motion carried by a unanimous
, voice vote.
B. Tentative Tract Plo. 36885
The staff report introduced a new six-unit condominium project at 1015-1019 Seven-
teent!: Street en, vacant property proposed by the 17th Alcy Partnership. Ken Golick
spoke as project representative as did project architect, Steve PascaTl,trho noted
that all trees on property ovould be preserved and displayed renderings of the project.

This matter was carried .over from the meeting of May 21st for
submission of elevations and clarification .of whether the park-
ing presently provided on the rear of 1446 - 9th Street was
required for any of the. construction in connection with the
existing commercial construction on Lincoln Boulevard.
Review of the building permits indicates the existing buildings
on the Lincoln Boulevard frontage require a total of 21 parking
spaces while 24 are provided on these properties. The current
parking on the rear of 1446 - 9th Street is therefore not re-
quired to support construction elsewhere.
It has also been alleged that the proposed new construction would
be used for manufacturing rather than office use, specifically the
use of machines to manufacture seat covers. FJhi1e such use might
be permitted in a C4 District under certain circumstances under
the Conditional Use Permit procedure, the application is approved
on the basis of the applicant's presentation and the Planning Com-
mission may impose whatever conditions it feels warranted. Further,
the Conditional Use Permit grants to the applicant only those
rights which the Commission intended to grant on the basis of the
allegations presented. and no additional rights accrue to the ap-
plicant. The applicant; iri this case asks for office and storage
use and nothing further. No right to use the premises for manu-
facturing is requested but in the interest of clarification it may
be helpful to impose a specific prohibition against it.
RECOi+IMENDATION. There being no bar to a favorable consideration
of the application by reason of the removal of the existing park-
ing, it is respectfully recommended that the application be approved
on the original conditions.

This is an application by John and Richard Robbins as the
owners of 2 R3 lots. at 1438 through 1446 - 9th Street to
construct a two story storeroom and office building over a
subterranean garage for 34 parking spaces. Public Hearing
on the application is set for Monday, May 21st before the
Planning Commission under the provisions of Section 9148 of
Chapter l Article TX of the Santa Monica Municipal Code.
PROPERTY INVOLVED. The property involved consists of two
50 x 150 lots located on the 4rest side of 9th Street 150'
north of Broadway. The property is presently developed with
a total of 5 units, 2 on the southerly lot and 3 on the north-
erly lot. All the units are. uninhabited, the 3 northerly
being in dilapidated condition and the 2 on the south being
in poor condition and in use for storage. The rear portion
of the southern most lot is paved and in use for parking of
3.o cars. The parking and storage are in connection with the
applicants' top shop and automobile upholstery business im-
mediately across the alley. The property immediately to the
south is in the C4 Commercial District and development con-
sists of an office building on the westerly portion and a retail
gardening supply business and exterior storage on the easterly
portion. This portion of the property is poorly maintained
and has been a source of concern to adjacent property owners
for many years. Enforcement activity, including prosecution
for zoning violations fora number of years have been unsuccess-
ful in getting the property maintained in a neat and orderly
condition. The property to the north is developed with 10 older
units on two lots with a 10' set back from 9th Street. Property
on the easterly side of 9th Street is developed with multiple
residential units in good condition.. Commercial activities
including automobile sales and a parking lot for Standard Brands
Paint occupy most of the northerly section of the block.
PROJECT PROPOSED. The applicants propose to erect a 2 story
structure with a full subterranean garage entered from 9th Street
containing 34 parking spaces and an additional 8 parking spaces
at grade entered from the alley for a total of 42 parking spaces.

The first floor of the building will contain 9900 sq. ft. of
storage area and the second floor will contain 9400 sq. ft. of
office .space. The storage area will be used in connection with
the applicants' auto top business and the office space will be
for rental. The office and storeroom area will be serviced by a
lobby entered from 9th Street and includes an elevator serving
the basement and. two upper levels.
The two upper floors will maintain a 10' side yard on the north,
a 10' front set back, a 25' rear set back on most o£ the alley
frontage and a IO' side yard on the second floor along the south-
erly side. The first floor will maintain no side yard on the
southerly side for a distance of 100' immediately adjoining the
commercial zone.
PERMISSIBLE ZONING. Under the existing R3 zoning, the property
may be develope with 16 dwelling units either apartments or
condominiums. The height limit is 3 stories and 40'. The lot
could be developed singly or as a double 100' parcel. A three
story apartment or condominium would require 11' side yards on
either side. A twa story apartment would require 9' side yards.
The required set back would be 20'. A total of 32 automobile
parking spaces would be required.
The entire property may also be used as an automobile parking
lot.
CODE PROVISIONS. Under the Conditional Use Permit procedures
contained in Section 9148, the Planning Commission or City
Council may permit the establishment of commercial uses within
a multiple residential district under certain conditions in-
cluding the following:
1. The site is contiguous with and immediately
adjoins an established commercial district.
2." The uses permitted are limited to those per-
mitted in the adjoining established commercial
district.
3. In no case shall commercial uses be extended
more than 500' into any adjoining residential
district.
This section requires a finding that the proposed use and loca-
tion are in accordance with good zoning practice, in the public
interest and necessary in order that substantial justice be done
and subject to such conditions as may be necessary to insure
that the use is compatible with existing and potential uses
within the general area, that traffic or parking congestion will
not result, that the public health, safety and general welfare
are protected and that no harm to adjacent property will result.

ANALYSIS AND EVALUATIOLd. Evaluation of the proposed project
indicates that with certain conditions to protect and enhance
the adjacent residential uses the project represents a reason-
able and compatible transition between the active commercial
development on Lincoln and Broadway and the residential uses
on 9th Street. The proposed structure would provide greater
side yards on the north side and second story of the south side
than S•rould be required for a comparable apartment. The rear
yard is greater than would be required and the proposed front
yard while 400 sq. ft. short of the actual requirement is the
same. as that of the adjoining residential development and 10`
greater than that which might exist on a commercial development
to the south. Required parking for the structure would be 41
spaces, one less than that provided.
In many respects the proposed development would have less
detrimental. impact on the adjoining residential uses than would
an apartment or condominium and would be far more beneficial
than a parking lot.
SUMMARY AND RECOb1MELdDATI0NS. Evaluation of the application indi-
cates that the proposed uses are in accordance with good. zoning
practice, in the public interest and necessary that substantial
justice be done and it is respectfully recommended that the

2. That the front and side of the building shall be approved
by the Architectural Review Board, shall be devoid of any
commercial signing other than an address, all identification
or directories to be confined to the interior of the lobby,
the front and side of the exterior of building to present a
reasonable appearance of a residential building_ ~
3. That the large street palm tree on the southern most
boundary shall be maintained and substantial landscaping
installed and maintained subject to approval of the Archi-
tectural Review Board.
4. That the first floor area shall be used for storage only,
the remainder of the building to be limited to office uses
and no restaurant, entertainment, manufacturing or other such
uses and are to be at all times conducted in a manner not
detrimental to surrounding properties by reason of .noise,
lights, appearance or other activities.

structure will be an asset. It will alleviate traffic in the
alley and be easier for trucks to get in and out.
The proposed structure Mr. Robbins is planning will definately
improve the look on 9th Street. T feel they should be permitted
