Introduction
This report transmits an appeal from the Planning Commission's
determination to deny a Tentative Tract Map for construction
of a new 4 unit condominium project at 1317-19 Palisades Beach
Road.
Background
On February 28, 1979 an application was filed for construction
of a new 4 unit condominium on a 50 x 100' R4 lot at 1317-19
Palisades Beach Road in the R4 District. The property is pre-
sently developed with 9 older units in poor condition and the
surrounding area is developed with 1 and 2 story buildings and
some vacant lots. The proposed project consists of a 3 story
structure over subterranean garaging for 9 automobiles.
The proposed project is located in the coastal permit zone and is
in a critical issue area under consideration in the Local Coastal
Planning Program. The application. was first considered on
April 16th and continued to May 7th along with a number of othe~~

projects pending City Council action on a suggested moratorium on
applications involving existing dwelling units.

On May 7th the matter was considered by the Planning Commission
and denied on the basis that approval could prejudice the City
and Coastal Commission's ability to develop the Local Coastal
Plan. Construction of a_3'story condominium in this area while
the City and Coastal Commission are in the process of defining
Future uses could only further complicate the program. While a
similar project had previously been. approved by both the Planning
and Coastal Commissions for a nearby vacant lot, the importance
of delaying possibly incompatible development until the LCP's
adoption is a vital element of the program.
Alternatives
Under the City's Subdivision Ordinance the City Council may
affirm, reverse or modify any determination of the Planning Com-
mission in the .matter of a subdivision. The Council therefore
has the alternative of granting the appeal and reversing the
Planning Commission's action,.. denying the appeal. and upholding
the Commission's decision or granting the appeal with some modi-
fication of the proposed project. Inasmuch as 9 rental units
exist on the property, approval of the Rent Control Board would
also be required in addition to the City Council's and Coastal
Commission's approval.
Recommendation
In view of the Planning Commission's determination that approval
of the project would prejudice the City's and Coastal Commission's

ability to develop a Coastal :Plan as required by the California
Coastal Act of 1976, it is respectfully recommended that the
appeal be denied and the determination of the Planning Commission
upheld.

Agenda Item 7-D: Presented at this time was a public hearing to hear the
appeal of Michael E. Barsocchini, representing applicant Thomas Yedor,
from the denial by the Planning Commission of Tentative Tract Map No.
36786 fora subdivision for condominium purposes at 1317-19 Palisades
Beach Road. The proof of publication was ordered filed by Mayor van den
Steenhoven. The public hearing was opened at 11:34 P.M. by order of
Mayor van den Steenhoven who acknowledged the request of the appellant/
.applicant that the subject be continued due to his absence from this
meeting. The following members of the public spoke: Jay Cassidy asked
to be allowed to speak on the matter when it is returned to Council and
after hearing the grounds for the appeal. Joseph Cleeson requested
preservation of the architectural integrity of the coastal buildings.
At 11:36 P.M., Mayor Pro Tempore Reed moved to continue the hearing to
the City Council meeting to e eld August 14, 1979. Second by Mayor
van den Steenhoven.
Council Vote: Unanimously approved 7-0
