Monica.-California, March 27, 1980 T0: Mayor and City Council FROM: City Staff SUBJECT: Final Map Approval Introduction This report transmits a Final Map for City Council approval of the following. conddminium project which received Tentative Approval. November 19, 1979: TRACT ADDRESS. DEVELOPER. UNITS 38973 1834 Eleventh Street David & Donna Bentz 6 ;new) Background After public hearing and careful review of the record and staff recommendations, the City Planning Commission approved the Tentative Map for the above project. The action of the Planning Commission was bdsed on their finding that the pro- posed subdivision should cause. no substantial environmental damage and is in conformance with all state and local laws and regulations and applicable General Plan Elements. The final Map conforms to the Tentative Map. The License Division :reports .that the developer has either paid or agreed to pay the condominium tax. The Building and :Safety and Fire Departments indicate that the project meets present fire safety requirements.. Approval by the County Engineer's office has been received for the project. Two single-.family houses were removed March 25, 1979 and had been last occupied in August 1978.. Work was begun on the new project April 1, 1979 with the first floor in. .Alternatives State and City ordinances require apprcvaL of final subdivision maps which comply with approved Tentative Maps. Approval of the final Subdivision Map does not- KJ tom' Mayor and City Council Page 2 release the subdivider-from compliance with, any applicable requirements of the Rent Control Ordinance. Recommendation Inasmuch as the Final Map conforms to the approved Tentative Map, the buildings meet required safety standards and the tax has been paid or an agreement to pay executed, it is respectfully recommended that the City Council affirm the find- ings of the Planning Commission and approve said Map with the advisement that approval of the Final Subdivision Map does not release the subdivider from. compliance with the Rent Control Ordinance requirement for an exemption or removal permit.
