City .Staff SUBJECT:' Final Map Approval Introduction This report transmits a Final Map for City Council approvat of the following condominium project which received Tentative Approval August 20, 1979:. TRACT ADDRESS DEVELOPER UNITS 36889 831 Pacific Street David Cooper, Michael. Folonis, 6 (newj Richard Clemenson and Jose Maldonado Background .After public hearing and careful review of the record and staff recommendations, the City Planning Commission approved the Tentative Map for the above project. The action of the. Planning Commissioh was based on their finding that the pro- posed subdivision should cause no substantial environmental damage and is in conformance with all state and local laws and regulations and applicable General Plan Elements. The Final Map conforms to the Tentative Map. The License Division reports. that the developer has either paid or agreed to pay the condominium iax. The Building and Safety and Fire Departments indicate that the project meets present fire safety requirements. Approval by the County Engineer's office has been received r'pr the project. Removal of three units was completed December 21, 1979. Construction has not begun.: A Tetter from the Rent Control Bpard is attached as providing exemption June 6;1979. Alternatives State and City ordinances require apprgval of final subdivision maps which comply. with approved Tentative Maps.. Approval of-the Final Subdivision Map does not. ~~ & igBO Mayor and City Council Page 2 release the subdivider from compliance with any applicable requirements of the Rent Control Ordinance. Recommendation Inasmuch as the Final Map conforms to the approved Tentative Map, the buildings meet required safety standards and the tax has been paid or an agreement to pay executed, it is respectfully recommended that the City Council affirm the find- ings of the Planning Commission and approve said Map with the advisement that approval of the Final Subdivision Map does not release the subdivider from compliance with the Rent Control Ordinance requirement for an exemption or removal permit.
