Staff SUBJECT: Final Map Approval Introduction This report transmits a Final Map for City Council approval of the following condominium project which received Tentative Approval June 16, 1979: TRACT ADDRESS DEVELOPER UNITS 37245 1033 Ocean Avenue Gary Nathanson & 16 (new) Richard A. Handel Background After public hearing and careful review of the record and staff recommendations, the City Planning Commission approved the Tentative Map for the above project. The action of the Planning`Commission was based on their finding that the pro- ~ posed subdivision should cause no substantial environmental damage and is in confdrmance with a17 state. and .local laws and regulations. and applicable General Plan Elements. The Final Map cdnforms to the Tentative Map. The License Division reports that the developer has either paid or agreed to pay the condominium tax. The Building and Safety and Fire Departments indicate that'tfie project meets present fire safety requirements. Approval by the County Engineer's office has been received for the project. Six units were removed from the. property by February 3, 1978. No building permit has been issued and the property is still vacant. The project is in the Coastal Zone. Alternatives i State and .City. ordinances: require apprpval of final subdivision maps which comply with approved Tentative Maps. Recommendation Inasmuch as the Final Map conforms to the approved Tentative Map, the buildings meet required safety standards and the tax has been paid or an agreement to pay executed, it is respectfully recommended that the City Council affirm the find- ings of the Planning Commission and approve said Map with the advisement that approval of the Final Subdivision Map does not release the subdivider from compliance with the Rent Control Ordinance requirement for an exemption or removal permit.
