Introduction This is an appeal from the Planning Commission's denial of a re- quest £or extension of a Tentative Tract Map involving a condo- minium conversion. Appeal is by the subdivider Paul Aras. Background On May 7, 1979 the Planning Commission approved a Tentative Tract Map for conversion of an 10 unit apartment building at 1134 - 11th Street to condominiums. Among the conditions imposed was approval by the Rent Control Board and the installation of automatic se- curity gates on the front garaging. On March 17, 1980 the applicant requested an extension of the Tentative Tract Map indicating that more than $20,000 had been spent in preparation for the conversion. Following consideration of the requested extension on April 7, 1980 the Planning Commission denied the extension primarily on the basis that the applicant had not made application to the Santa Monica Rent Control Board. On April 14, 1980 the Planning Commission action was appealed to the City Council. ~Y 2 '~ 19130 7~ ~tAY 1 3 19$0' Mayor and City Council -2- April 30, 1980 Alternatives The City Council may affirm, reverse or modify any action by the Planning Commission in regard to a subdivision. In the case of an appeal by the subdivider the Council is not required to determine whether the appeal shall be considered but must hear the matter and make a final determination. An appeal is a public hearing and the tenants of the apartment under consideration have been notified of the meeting. Recommendation In view of the applicant's failure to diligently pursue the proposed conversion by application to the Rent Control Board as required by the Planning Commission's tentative approval, it is respectfully recommended that the appeal be denied and the decision of the Commission affirmed.
