No. 35412; 120 Unit Condominium Conversion, 1221

Introduction
This is a request for approval of a Final Tract Map for 120 unit
condominium conversion. Request is by Sherman L. Stacey as
attorney for the subdivider.
Background
The Tentative Tract Map was approved on February 26, 1979. The
only unusual physical requirement was a substantial landscaping
requirement which was subsequently transferred to the Arizona
Plaza Project.
On February 4, 1980 the Planning Commission granted an extension
to June 1, 1980 on condition a Certificate of Exemption, removal
permit or vested right be obtained from the Rent Control Board
and Coastal Commission approval be obtained prior to the Final
Map. The extension was appealed by both Council member Jennings
and Wilshire West and both appeals were denied.
The applicant is now seeking Final Map approval on the basis that
all conditions of the Tentative Tract Map have been satisfied,
that the Final Map was filed on January 14, 1979 and but for the
Council's policy of not considering Final Maps until after rent
control action the Final Map would have been considered prior to

its expiration on February 25, 1980. The Council policy re-
quiring prior rent control approval was rescinded March 13, 1980.
Recommendation
Irrespective of its later rescission the Council's Rent Control
policy precluded considerations of the Final Map until the Tentative
Map expired and the extension imposed Rent Control approval. It
is respectfully recommended that the request be denied and Final
Map approval deferred until the conditions of the extension have
been complied with.
