SUBJECT: Request of Susan Gelender to address the Council
regarding Tentative Tract No. 29016, 6 Unit
Condominium Conversion, 947 - 15th Street -
Kahala Homes, Inc.

This matter was carried over from the meeting of March 25, 1980
for information regarding records of development.
Background
The Tentative Tract Map was approved September 19, 1977 on
condition that the CC&Rs state that the central gas system is
to be use d. for the circulating hot water system and gas log
fireplaces only, that prospective buyers of units 2 and 4 are
advised to expect plumbing and impact noise from the units
above and that the light well in front be investigated and if
legal screened by landscaping.
On December 5, 1978 the. new owners of the building requested
an extension of time to complete the work necessary for the
Final Map. The extension was granted on January 8, 1979.
On June 12, 1979 the applicants filed the Final Tract Map and
the matter was placed on the City Council Agenda of July 24,
1979. On July 23rd the matter was withdrawn from the Agenda j ~°
by City staff due to some uncompleted building and safety Y ?: ~~~~
requirements with buildings. ~/y

Review of Building Department records indicate a permit was
taken out on March 15, 1979 for work in connection with the
Conversion and a second permit on May 18, 1979 to rebuild
the patio roof in the front light well. On July 23, 1979
the building inspector found several building and safety
violations in connection with the building and notified the
Planning Department of the situation. Final approval on
both permits was granted on September 14, 1979 and the matter
was rescheduled for the Council meeting of October 9, 1979.
On October 8, 1979 the matter was again withdrawn, this time
by the City Attorney after the Legal Aid Foundation of Los
Angeles challenged the Final Map on the basis that the Tentative
had lapsed on September 19, 1978, that no request for extension
was made until December 5, 1978 and that the Planning Commission
was without power to extend a Tentative that had expired.
In the absence of any precluding circumstances, the one year
extension expired on September 19, 1979. No further action
occured in the case until February 11, 1980 when Susan Gelender
requested time to address the Council.
