Map for City Couhcil approval of the following condominium project which received Tentative Approval November 5, 1979. TRACT ADDRESS DEVELOPER UNITS 37943 1118 Seventeenth Street Jack Kavanaugh and Mead I. Greenberg 5 (new} Background After public hearing and careful review of the record and staff recommendations, the Lity Planning Commission approved-the Tentative Map for the above project. The action of the Planning Commission was based on their finding that the pro- posed subdivision should cause no substantial environmental damage and is in conformance with. all state and local laws and regulations and applicable General .Plan Elements. The Final Map conforms to the Tentative Map. The License Division reports. that the developer has either paid or agreed to pay the condominium tax. The Building and Safety ahd Fire Departments indicate that the project meets present fire safety requirements. Approval by the County Engineer's office has beeh recei-ved for the project. Four units were removed on March 28, 1979. when the Demolition Permit was issued. Current owner purchased the property as a vacant lot and began construe- . tion on January 21, 1980 and the work is twenty-five percent (25%) complete. Alternatives State and City ordinances require approval of final subdivision maps. which comply with approved Tentative Maps.. Approval of the Final Subdivision Map does not N1AY 1 3 1980 i ®~ MAY 1 ~ f4Rn Mayor and City Council Page 2 release the subdivider-from compliance with any applicable requirements of the Rent Control Ordinance. Recommendation Inasmuch as the final Map conforms to the approved Tentative Map, the buildings meet required safety standards and the tax has been paid or an agreement to pay executed, it is respectfully recommended that the City Council affirm the find- ings of the Planning Commission and approve said Map with the advisement that approval of the Final Subdivision Map does not release the subdivider from compliance with the Rent Control Ordinance requirement for an exemption or removal permit.
