Introduction
This is an appeal from the Planning Commission's denial of a
request for extension of a Tentative Tract Map for a six unit
condominium conversion. Appeal is by the subdivider.
Background
On June 4, 1979 the City Planning Commission approved a Tentative
Tract Map for conversion of a six unit apartment to condominiums.
Among the conditions imposed were the .installation of security
gates and approval by the Rent Control Board. On March 25, 1980
the applicant requested an extension of the Tentative Tract Map
indicating that substantial sums of money for engineering and
other costs in connection with the project had been expended and
a law suit filed against the Rent Control Board. Inspection
of the premises revealed that none of the physical improvements
had been accomplished. Following consideration of the request
on April 7, 1980 the Planning Commission determined that the
extension should be denied on the basis that no application to
the Rent Control Board had been made nor the improvements re-
quired completed. On April 11th the Commission's action was ap-
pealed to the City Council.

Alternatives
The City Council may affirm, reverse or modify any action by
the Planning Commission in regard to a subdivision. In the case
of an appeal by the subdivider the Council is not required to
determine whether the appeal shall be considered but .must hear
the matter and make a final determination.
An appeal is a public hearing and-the tenants of the apartment
under consideration have been notified of the meeting.
Recommendation
In view of the applicant's failure to diligently pursue the pro-
posed conversion by application to the Rent Control Board as re-
quired by the Planning Commission's tentative approval, it is
respectfully recommended that the appeal be denied and the
decision of the Commission affirmed.
