Discussion

ar~d parking meter equipment for new mstallations, and repair and maintenance ~f
ex~sting equipment ~n 1978, the C~ty Council adapted a reso~ution (Resolution No

purchase of parking meter equipment In 198D, the Cour~cil did the same far the

the market far these equipment and, finding it ~s appropriate to continue the current no-
b~d ~urchas~ng pract~ces, recommer~ds that Counc~l renew its previous actror~ ar~~!
approve the attached resolut~or~s pursuant to Murncipal Cade Section 2 24 08~
The City uses only Econol~te traffic s4gnal control equipment In the early 80's staff
determined that Econolite manufactured "tap of the I~ne" eqwpment, wo~ld be m
business a long time, provided excellent customer service, and would constantly
de~elop state af the art equipment The City Council s~bseq~ently determmed that the
Crty's traffic s4gnal control system would be exclusi~ely Econolite This decision was
re-evaluated m 1989190 when a fully camputeriz~d traff~c srgnal control system was
contemplated It was again determined that Econolite would p~ovide the best quality
product for the City
Staff has recently reviewed this policy and found that Econolite rema~ns an mdustry
leader The benefits of remaining with Econolate as well as the costs associated with a
change to alternate and incompatible equipment make it desirable to remam an
Econolite system Econolite is it's own manufacturer, distr~butor and serv~ce prov~der
For par~Cmg meter equipment the City purchases djrectly from Duncan Industries, a
manufacturer The City has been using Duncan parking meter equGpment since the
1960's because they manufiacture "top of the line" equipment. are a manufacturer that

woUld be in busaness a long time, provide excellent customer service, and are an

In recent years, s#aff has purchased and e~aluated parking meter equipment from other
manufacturers and found their products are not compa#~ble or af the same quality as
Duncan fndustries Parts from other manufacturers aften did not work in the Duncan
parking meters and often times parts broke or malfunctioned A change of the current
pract~ce will increase meter malfunctians and maintenance Cityw~de, and w~11 result in
additionai time and costs for repairs The CFty currently apera#es and maintains about

Jack-In-Box Drive-Through, 2423 Wilshire Blvd.
Dear Planning Cnmmissioners:
I am sorry that I will not be able to attend the Planning
Commission Hearing next week concerning the C.U.P. for the Jack-
in-the-Box Drive Through.
I have attended all the other hearings on this issue, and I
feel strongly about limiting the hours of operation for the
Drive-through. My husband and I are long time Santa Monica
residents. We live on 24th Street, just north of Wilshire Blvd.,
and the rear of our home is adjacent to an alley, about half a
block from trie drive-through.
There have been many disturbances in the middle of the night
from car horns, loud stereos, people yelling, and the loud
microphone speaker. We have spent many nights unable to sleep
because of these disturbances.
I am asking you to please limit the operation oP the Drive-
Throuqh to - Sun. to Thurs. 7:00 a.m. to 10:00 p.m. and Fri. and
Sat. 7:0o a.m. to 12:00 a.m.

safety of our neighborriood.

William B. Rudell, an attorney for Tommy's, said
the company has tried to conurol crowds thai gacher

weekend nights. But he said the restaurant can't be

"We have no means af controlling incidents on

She stated that a copy of the Traffic Management Handbook will be forwarded to the
Commission. Lastly, she stated that unless some items need to be connnued, ihe
December 13, 1995 meenng of the Commission wiIl be cancelled.

viable. VIr Bruce Cameron of Mann Theaters srated that variables mclude sux
of the screen, s~ze and configuraaon of the room as well as the number of seau.
He stated that a theater of 140-150 seats would be too small for the enjoyment
of the audience

Ms. Fnck responded to a pubhc inqmry regazding secunty sayuig that the Ciry
Council had requested that a secunty guard be present for late night dnve-
through hours. She stated for the record that calls for service to the Police
Departinznt between Jaauary 31, 1994 and February 28, 1995, durmg the
evemng hours, have numbered fifteen incidenu, none of ihem for noise.
Comro,ssioner Wermmk quesnoned the need for secunry between six and seven
in the moming. ~Ms. Ginsberg responded that staff reasoned that security should
be requued in any addiaonal hours of operation specified by the CUP.
Comm,'.csioner Weremiuk asked what hours were covered in the calIs for service
record. Ms. Frick stated that the hours were from 10 p.m. to 7 a.m. and tbat
most of the calls occurted after audmght.
Commissioner Gruber asked why a security guard is not requued all nighi long
if the restaurant is open all night.
Mr Rubens spoke m rebuttal to the public comment.
Comaussioner Zmner commented that the phowgraphs do not show where the
noise bamer is to be placed or if trees need to be removed for the bamer to be
~~~ built. Mr. Rubens stated that this is true and that no uees will be removed.
Commissioner Zinner asked vir. Rubens if the bamer design has been shown to
the neighbors. Mr. Rubens stated that he assumed that smce the design is part of
the applicanon that tlns was not necessary

walUbamer seems to be a reasonable soluaon, however he quesuoned whether it

Commissioner Weremiuk questioned the effecdveness of the proposed wall and
noted that wirile it will help with speaker noise, ~t v~nll not help with vehicie
noise. Ms. Fnck stated that the Commission can specify that the wall meet
certain sound standards at adjacent propernes.
Comaussioner Pazlee commented on vetucle noise.
Commissioner Gruber expressed doubt that any mitigauon measures will work ro
reduce the noise problems described by the public.
Commis"sioner Moench s~ted that he is not sympathetic to the application. He
aslced about extending the noise wall to the sidewalk and addmg a curb cut. Ms.
Frick stated that such a change would require continuing the item until the Crty
Traffic Engineer could review the plans.
Commissioner Zmner commented that the issue is havuig the convenience not to
pazk your car He expressed support of banning all drive-throughs. He also
stated that the busmess should abide by the Ordinance houcs of operation.
Chazr Breisch commented that this is tough situahon and that there will probably
always be some sort of noise at this locauon.
Commissioner Vl%eremiuk stated the people have an absolute right to sleep and
expressed suppon for the CUP wrth dnve-through closure at 10 p.m. Sunday
through Thursday and 11 p.m. on Friday and Sat~sday if the sound wall in
installed and a s~lent order box is included.
Commissioner Gruber expressed a preference of sncking to the Ordinance hours
of midmght on Friday and Saturday He also stated that the residents who spoke
did not mdicate any confidence or design for the proposed sound wall.
Commissioner V/eremiuk made a mohon for approval with the foilowing
modificanons• that the dnve-through hours be 7 am. to 10 p.m. Sunday through
Thursday, unnl midnight on Fnday and Sarurday; that the sound wall shall allow
no more that ~0 db at adjacent properues. that no ~ees be removed when the
wail is erected, and that a secunty ;uard be present between IO n.m. and
midnight on Friday and Saturday mghu.
Commissioner Pazlee seconded the mouon. He suggested that the applicant

Mr Rubens spoke in rebuttal to the public comment
Commiss~oner Weremiuk commented on noise mitigation and asked how the
kiosk would work. Mr. Gaia stated that the kiosk will desi with all drive-up
orders and a new speaker system has been installed for regular hours of
operation. He stated that the kiosk will eliminau the speaker noise and increase
the speed of service. He also stated that he decided aga,*+~t a sound wall because
it would obscure alley vision and could lead to accidents.
Commissioner Weremmk asked how the ldosk would work. Mr. Gaia staced that
rt would be like Fotomat with a person taking orders, but not money, and
sending the vehicle on to the pick-up windows for theu order.
Com*nissioner Gruber asked why the kiosk could not be used all day. Mr. Gaia
stated that this is being reviewed, however the problems cited by residenu occur
at night. He also stated t6at it would be costly to run the kiosk at all hours.
Commissioner Pariee asked for the hours of operation for this establislunent
Mr. Gaza stated that his restaiuant is open 24 hours a day, 7 days a week, and
has been for 30 yeazs.
Commissioner Zmner asked if the installation of tree might not aiso cause a line
of sight problem. Mr. Gaia stated that the ~ees wiil not be solid and should
provide a good sound buffer.
Chair Breisch closed the public hearing.
Commissioner Zmner asked how much noise reducuon can be accomplished by
the planting bamer. Ms. Frick stated that plantings are a proven method for
sound buffers, however she did not have sratisacs to back th;c up.
Commissioner Pazlee commented that such buffers need to be maintained over
hme He stated that he appreciates the applicant~s proacuve approach, however
the plans provided do not show the planters he observed az the site. He
expressed support for the ltiosk concept. He stated that he could not support the
hours requested for this location and noted that the permrt will be void in two
years.
Deputy Cit~ Attomey Strobel remmded the Commission that the ordinance
allows the establishment to apply for a CUP for extended hours after 1Q p.m.
and that this applicant has chosen to apply for that extension for the two year
penod. She stated that the Co*nnussion must decide whether the conditions can
be made to grant the extension.
Commissioner Gruber commented that dnve-through uses aze not ~ood for the

Comaussioner Bradiey commented on the distance between the estabIishment and
the motel and adjacent residenu. He expressed the belief that the cypress trees
would be a good sound buffer.
Comm~ssioner Moench made a motioa to go past 11 p.m. Comm;ssioner Pulee
seconded the motion, which was approved by voice vote.
Chair Breisch stated that he is very sympathetic to the operator, however there
must be cons~stency as regazds the protection of residents from noise. He stated
that he could agree to longer dnve-through hours for this establishment if cnteria
can be developed
Commissioner Pazlee expressed the opinion that longer hours daily could be
approved. He commented on Finding #3 and s~ze and acUvities surrouading the
parcels m ttus area He stated that a more acciuate plan of the site is needed and
that it should mclude the planters. He aiso felt the 50 db staadard could be
used, but the distance needed to be determined.
' Commisstoner W eremiuk expressed agreement with Commissioner Pazlee. She
stated that staff needs to supply some standards. She questioned allowing the
estabhshment to operate unril I a.m. seven days a week, however she felt that
the kiosk would elimu-ate the need for a security guard.
Commissioner Gruber asked how the Com_mi~sion is to proceed as regazds
makmg fmdings. He suggested that the Police Deparanent be contacted
regazdmg their opuuon on the estabhshmenu hours at this location. He
expressed the opituon that the establishment is a benefit to the neighborhood
because of its night 3iehung and employees on-s~te. Ms. Fnck stated that if the
plans aze to change, then the uem must be conunued and a new heanng must be
conducted. She also stated that the Comaussion needs to direct staff regazding
findings
Commissioner Pazlee asked about the sound pazameten for ttris location. Ms.
Frick stated that standards similar to the PSP standards need to be devised with
idennficauon from the locauon, i.e. to the motel on Grant, to the condom~n~ums
on Bay Street She also stated that the raotel acu a buffer for the residenu on
Grant Avenue.
Commissioner ~~eremiuk stated that the "res~dennal" motel must be protected
from noise Ms Fnck stated that the noise levels should then be taken from
across tne allev She srated that a noise consultant will be contact.

for the site, and specifically at the alley. He also stated that the noise consultant
needs to determuie what measutes wiil result in a 50 db at the opposue side of
the alley. Ms. Fnck stated that the applicant's noise consuitant will handle the
last request.

maceh the photographs of the site submitted with thts application. He also
question the noise variation betweea ordering at the window versus the laosk.

Subject: Proposed ordinance which would limit the hours of
drive-up windows in fast food restaurants located
adjacent to residentially-zoned property, effective
May 1, 1998. ~
Dear Planning Commissioners:
We urge you to approve the above referenced ordinance which City
Council has proposed.
We are residents who own property and are living adjacent to or
nearby a Jack-in-the-Box Drive-Through restaurant located at
Wilshire Blvd. and Chelsea Ave., which operates without a permit
and is open 24 hours a day. We have been living under adverse
conditions for several years due to the increase in late night
noise disturbances from vehicles, rude, loud and often
troublesome drive-through customers, and frequent problems with
the microphone squawk-box.
We have given testimony reqarding this situation to City Council
at hearings from September, 1994 through March, 1995, and we will
present our testimony to you at future Planning Commission
hearings on these drive-through restaurants issues.
We are grateful to City Council for providing legislation that
will permanently address the drive-up window late night noise
problems which have affected many Santa Monica residents living
adjacent to or near these restaurants.
Thank you for considering this legislation which is crucial to
our well being and safety, and quiet enjoyment of our property
and homes.

CONDTTIONAL USE PERMIT FINDINGS
1. The proposed use is condiUOnally permitted withm the sub~ect distnct and complies with
all of the apphcable provisions of the "City of Santa Momca Comprehensive Land Use and
Zonmg Ordmance", m that the dnve-up wmdow operatron has been m existence since
1965.
2. The proposed use would not impair the integnty and chazacter of the distnct m which it
is to be estabhshed or located, m that the noise ~mpacts of extending the hours of operahon
of the drive-up wmdow from 7:OOam to 10.00pm dazly to between 6:OOam and i:00am
Sunday through Thursday and from 6•OOam to 3:OOam on Fndays and Saturdays can be
reduced with the operahon of the kiosk and mcreased landscapmg proposed by the
apphcant and recommended by staff as a condihon of approval of this CUP.
3. The sub~ect parcel is physically suitable for the type of land use being proposed, m that
the exisring land use will remam and the physical expansion associated with this
apphcauon is hmued to mstallanon of a kiosk and landscapmg as shown on plans dated
August 15, 1995 and January 12, 1996.
4. The proposed use is compahble with the land uses presently on the sub~ect pazcel m that
the existmg land use will remam.
5 The proposed use would be compatible with exist~ng and permissible land uses wrthm the
distnct and the general area in wh~ch the proposed use is to be located, in that the
proposed use (a dnve-up window) has been m operahon smce 1965. Additronally the

lirruted to the mstallation of a kiosk and landscaping as shown on plans dated August 15,
1995 and January 12, 1996.
7. Public access to the proposed use will be adequate, m that no alteraUons to exishng
parking, circulation or access are proposed as part of th~s applicaUon.
8. The physical location or placement of the use on the s~te is compaUble with and relates
hannomously to the surroundmg neighborhood, m that the physical expansion associated
with this apphcation is hmited to the installaUon of a kiosk and landscapmg as shown on
plans dated August 15, 1995 and January 12, 1996.
9. The proposed use is consistent with the goals, ob~echves, and pohcies of the General Plan,
m that no change of use at the sub~ect property is proposed m this apphcation.
10. The proposed use would not be detnmental to the public interest, health, safety,
convemence, or general welfare, in that the adverse impacts of extendmg the hours of
operahon of the dnve-up wmdow from 7•OOam to 10:00pm daily to between 6:OOam and
1:OOam Sunday through Thursday and from 6.OOam to 3 OOam on Fndays and Saturdays
can be reduced w~th the operanon of the kiosk and increased landscapmg as proposed by
the applicant and recommended by staff as a condiUOn of approval of this CUP.
11. The proposed use will not result m an overconcentration of such uses in the immediate
vicmity m that the dnve-up window use will not change.
Plans
1. This approvai is for those plans dated on August 15, 1995 and January 12, 1996, copies
of which shall be mamtazned m the files of the Plamm~g and Zomng Drvision. Project
development shall be consistent w~th such plans, except as otherwise specified m these
conditions of approval.
2 The Plans shall comply with all other provisions of Chapter 1, Article IX of the Mumcipal
Code, (Zorung Ordinance) a-~d all other pertinent ordmances and General Plan policies of
the City of Santa Momca.
Minor amendments to the plans shall be subject to approval by the Director of Planmng
and Commumty Development. A sigmficant change m the approved concept shall be
sub~ect to Plamm~g Commission Review. Construction shall be m conformance with the
plans submitted or as modified by the Plannmg Commission, Architectural Review Board
or Director of Plannmg and Commumty Development.
Architectural Review Board
Plans for the kiosk, addmonal landscapmg and the new locat~on of the menu board
contained in th~s apphcanon shall be sub~ect to review and approval by the Architectural
Review Board. Plans shall be subrrutted to the Architectural Review Board in accordance
with the submittal gmdeLnes.
Construction
5. Unless otherwise approved by the Department of Environmental and Public Works
Management, all sidewalks shall be kept clear and passable dunng construct~on.
6. 5idewalks, curbs, gutters, pavmg and driveways which need replacmg or removal as a
result of the pro~ect as determmed by the Department of Environmental and Public Works
Management shall be reconstructed to the sausfaction of the Department of Environmental
and Pubhc Works Management. Approval for this work shall be obtazned from the
Department of Emironmental and Publ~c Works Management pnor to issuance of the
building permits.
7. Vehicles hauhng dirt or other construction debns from the site shall cover any open load
with a tarpauhn or other secure covenng to mmimize dust emissions.
8 A s~gn shall be posted on the property m a manner consistent with the pubhc heanng sign
requirements wh~ch shall identify the address and phone number of the owner and/or
appl~cant for the purposes of respondmg to queshons and complaznts during construct~on.
Said sign shall also mdicate the hours of permissible construct~on work.
9. The property owner shall msure any graffih on the site is promptly removed through
comphance with the Crty's graffin removal program
10. A copy of these conditioas shall be posted m an easily visible and accessible locarion at
all umes during construchon at the project site. The pages shall be laminated or otherwise
protected to ensure durab~lity of the copy.
Miscellaneous Conditions
11. The dnve-up window hours of operanon shall be from between 6•OOam and 1:OOam
Sunday through Thursday and between 6:OOam and 3:OOam Fnday and Saturday.
12. The operation of the drive-up window shall be conducted in a manner not detnmental to
surroundmg propertres or residents by reason of lights, noise, actrvihes, parlang or other
actions.
]3. Street and/or alley l~ghtmg shall be provided on pubhc nghts-of-way ad~acent to the
pro~ect if and as nceded per the specificahons and with the approval of the Department of
Envuonmental and Pubhc Works Management.
14. The hours of operat~on of the dnve-up wmdow shall be consp~cuously displayed inside and
outside of the restaurant.
Vahditv of Permits
15 In the event permrttee v~olates or fails to comply with any conditions of approval of
thispermit, no further permrts, hcenses, or approvals shall be issued until such violahon
has been fully remedied.
16. Withm ten days of Plannmg Division uansmrttal of the Statement of Official Action,
pro~ect apphcant shall s~gn and return a copy of the Statement of Offic~al Action prepared
by the Plannmg Drvision, agreemg to the Condmons of approval and acknowledgmg that
fazlure to comply with such condiUOns shall constitute grounds for potenrial revocation of
the permit approval By sigmng same, apphcant shall not thereby waive any legai nghts
applicant may possess regardmg said cond~Uons The signed Statement shall be returned
to the Plamm~g and Zomng Divis~on. Fulure to comply with this cond~tion shall conshtute
grounds for potennal permit revocanon
17. The approval of this permit shall expire one year from the permit's effecrive date, unless,
m the case of new development, a buildmg pernirt has bcen obtazned pnor to the expuation
of this appmval m order to exercise the nghts granted by this approval. This permit shall
also expue if the bu~lding perm~t expires or if the nghts granted under this approval are
not exercised within one year fotlowmg the earhest to occur of the followmg: issuance of
a Cerhficate of Occupancy or, if no Certrficate of Occupancy is required, the last required
final mspecnon for the new construction. One six month extension may be permitted if
approverl by the Director of Plannmg and Communrty Development.
5necial Condit~ons
18 The kiosk as shown in the plans daterl August 15, 1995 and January 12, 1996, shall be
uhlized without loud speaker amplificahon between the hours of 10:00pm and 1:OOam
Sunday through Thursday, 10:00pm and 3:OOam Fnday and Saturday and 6:OOam and
7:OOam daily. A sign mdicatmg that fast-food orders will be taken at the laosk and the
hours of operahon of the laosk shall be conspicuously d~splayed at the menu board.
19. AddiUOnal landscapmg shall be mstalled along the eastern property Ime as mdicated on the
plans dated January 12, 1996, sub~ect to review and approval of the Architectural Review
Board. The landscapmg shall be of a sufficient density and matunty to attenuate the noise
associated with the dnve-up window operadons and reduce the noise impacts on ad~acent
residendally-zoned properties to the east to be m conformance with the Noise Ordmance;
otherwise, altematrve mingahon measures shall be mstalled that shall mingate the noise
impacts consistent with the Noise Ordmance.
20 The hours of operauon of the dnve-up wmdow contamed m this permu it shall take effect
upon the mstallaaon of the lnosk and landscapmg as proposed by the apphcant. Until such
ume as the laosk and landscapmg are mstalled and approved by the City, the hours of
operahon of the dnve-up wmdow shall be 7:OOam to 10:00pm daily.
