with Nonzero Architecture for Tenant Improvements of the New CityTV
Facility at 1654 19th Street
Recommended Action
Staff recommends that the City Council authorize the City Manager to negotiate and
execute a second modification to the Professional Services Agreement No. 9014 (CCS)
with Nonzero Architecture in the amount of $57,703, for a total contract amount of
$261,009, for additional design services for tenant improvements of the new CityTV
facility at 1654 19th Street.
Executive Summary
A professional services agreement with Nonzero Architecture was approved by City
Council in December 2008 in the amount of $198,550 for the tenant improvements of a
new CityTV facility at 1654 19t" Street, and a first modification was approved by City
Council in July 2009 in the amount of $8,056 for structural design services. During the
design process, staff discovered additional services required to complete the project.
The. additional services in the total amount of $57,703 are related to seismic code
requirements, the storm drain system, restroom upgrades and waterproofing for the
building.
Background
On July 8, 2008, City Council approved a property lease at 1654 19th Street for the new
CityTV facility. The lease term was for ten years with two five-year options and included
an option to acquire the property.
On December 2. 2008, City Council approved a professional services agreement with
Nonzero Architecture to provide design. and bid preparation document services for the
tenant improvements of the new CityTV facility in an amount not to exceed $198,550,
including a 10% contingency. On July 28, 2009, City Council approved the first
modification to the agreement in the amount of $8,056 for additional structural design
services related to the mechanical requirements for the building.

Tenant improvements to the building are expected to cost approximately $2 million.
Given the City's large capital investment in the property, as well as the inconvenience
and reduced productivity that accompanies relocation, acquisition of the property was
recommended by staff and approved by City Council on October 27. 2009.
Discussion
The drawings for the tenant improvements are approximately 95% complete, with a few
plan check comments that need to be addressed. During the design and plan check
process, staff discovered additional services required of the project. The additional
services in the total amount of $57,703 are related to code requirements, storm drain
system, and waterproofing for the building.
Code Reauirements
Seismic Upgrades -During the plan check process, it was discovered that building
seismic upgrades are required according to the City of Santa Monica's Municipal Code
Chapter 8.64 (Seismic Strengthening Provisions for Existing Concrete and Reinforced
Masonry Wall Buildings with Flexible Diaphragms) enacted in 1999. The building owner
was required to perform a structural analysis of the building to determine if it meets the
minimum earthquake standards specified in the Municipal Code. If the building does
not meet these minimum earthquake standards, then the owner is required to bring the
building up to code. The cost to evaluate the building and prepare design details and
estimates for these seismic upgrades is $22,080.
Restrooms -The building has an existing men's restroom and women's restroom with
one toilet each. As required by the 2007 California Plumbing Code, one toilet and one
urinal are required in the men's restroom if there are less than 15 males in the building.
The code also indicates that the total number of toilets for females shall be at least
equal to the total number of toilets and urinals required for males. As a result, the
existing restrooms need to be redesigned to add an additional toilet in order to comply
with code. The cost to redesign the restrooms is $4,725.

Storm Drain Svstem
Staff performed an investigation of the existing storm drain system. The as-built
drawings were determined to be incorrect, and the existing storm drain system was
found to not allow for sufficient drainage off the site. The cost to perform investigations
and re-design the entire storm drain system is $25,398.
Waterproofing
After a heavy rain in 2009, staff noticed efflorescence on the south wall of the building
and water on the floor at several locations in the building. Investigations must now be
performed in order to determine how water is entering the building and how to make the
building water tight. Project drawings will also need to be revised to include
waterproofing details. The cost for these design and consulting services is $5,500.
Responsibility for the cost of the design services and improvements for seismic
upgrades, the storm drain system and. waterproofing, are part of the on-going
negotiations of the Purchase and Sale Agreement with the Seller.

Funds in the amount of $57,703 for this second modification are available in account
0044031.589000, City TV Studio-Adelphia Funds.
