sr-012610-4ac7® c;crar City Council Report Santa Monica City Council Meeting: January 26, 2010 Agenda Item: 1'f'"~' To: Mayor and City Council From: City Staff Subject: Resolution Declaring Vacant Council Seat Recommended Action Staff recommends that Council adopt the attached Resolution declaring. a vacant City Council seat, discuss the options and procedures to fill the vacancy, as provided for in Section 603 of the City Charter, and direct staff accordingly. Executive Summary Section 603 of the City Charter states, in part, that a vacancy on the City Council shall be filled by appointment within thirty days after the office is declared vacant, and if Council fail to fill the vacancy, Council shall forthwith cause an election to be held to fill such vacancy. This report recommends that Council adopt the attached Resolution. Staff also recommends that Council open discussion regarding options and procedures to fill the vacancy. Discussion On January 9, 2010, Mayor Ken Genser passed away after many years of devoted service to the City. The attached Resolution declares Mayor Censer's Council seat vacant in accordance with City Charter Section 603. Once the seat is declared vacant, Council has thirty days to fill the vacancy by appointment. If Council fails to fill the vacancy, Council shall forthwith cause an election to be held to fill the vacancy. 1 Past Practice Within the last 15 years two City Council seats have been declared vacant. On October 13, 1998, Council accepted Councilmember Asha Greenberg's resignation letter and .declared her seat vacant after she moved out of the City of Santa Monica. On January 27, 2009, the City Council declared a vacancy on the City Council due to -the recent death of Councilmember Herb Katz. After declaring the respective seats vacant, Council approved a motion to accept letters of interest and applications from residents for the vacant seats, directed staff to publish notices in appropriate locations and set a deadline for the receipt of applications and letters of interest. As to the seat left vacant by Ms. Greenberg, on December 15, 1998, not having made an appointment to the vacant seat within the time permitted, the City Council called a special election to fill the vacancy. As to the seat left vacant by Councilmember Katz, the City Council appointed Ms. Gleam Davis to the vacancy on February 24, 2009. Attached are a copy of the notice published in 2009 and a copy of the application made available to interested parties. Financial Impacts & Budget Actions The recommendation presented in this report does not have a budget or fiscal impact. There is no financial impact for a Council appointment to fill the vacancy. If Council 2 chooses to call a special election, staff will return with additional documents and information concerning costs. Approved: Maria M. If no appointment is made by that date, the City Council is required to call a special municipal election to fill the vacancy. The appointment is for a partial term ending November 2010. The vacant seat, whose 4-year term ends November 2012, shall be placed on the November 2010, ballot so voters may elect a Councilmember to serve the remainder of the term. The State Political Reform Act requires officeholders to disclose their financial interest and income which may be materially affected by their official action. The applicant appointed to serve in this position will be required to file a Statement of Economic Interest (Form 700)with the City Clerk's Office upon assuming office, and annually thereafter. The appointee will be subject to the Oaks Initiative. The Oaks Initiative prohibits City public officials who have approved or voted to approve a "public benefit" from receiving a "personal or campaign advantage" from the recipient of the "public benefit" for one year from the time the City public official leaves office, or five years after conferring the "public benefit," whichever is shorter.
