SEPTEMBER 22, 2009 -SPECIAL MEETING
A special meeting of the Santa Monica City Council was called to order by Mayor Genser at 6:24 p.m.,
on Tuesday, September 22, 2009, aYCity Council Chambers, 1685 Main Street.

CONVENE On order of the Mayor, the City Council convened at 6:24 p.m., with
all members present.
CLOSED SESSION: On order of the Mayor, the City Council recessed to hear closed sessions
and returned at 7:58 p.m„_with all members present, to report the
following:
2-A: Conference with Legal Counsel -Existing Litigation: Oshiro
v. City of Santa Monica, Case No. CV 08-07035 SJO.
Motion by Councilmember Davis, seconded from Councilmember
Holbrook, to approve settlement as follows: City will pay a total of
$82,500 to be split between plaintiff Oshiro and his attorney; disciplinary
suspension imposed upon plaintiff will be modified to 20 hours and
documentation in his personnel file will be revised to reflect the change. ;
Plaintiff will be (already has been) reinstated to a promotional list, the
reinstatement being made pursuant to a change in City policy applicable
to any City employee who appeals a disciplinary action while he/she is on
a promotional list. Plaintiff will dismiss both his administrative appeal

and hislavrsuit snd both sides will agree to confine any public statements
about the case to matters that aze part of the public record.
