sr-090809-1ii# until ert ~~tY of Santa Monica City Council Il~eeting: September 9, 2009 Agenda Item: `'~ Z- To: Mayor and City Council From: Andy Agle, Director of Housing and Economic Development Subject: Bayside Seasonal Ice Skating Rink Recommended Action Staff recommends that the City Council authorize the City Manager to negotiate and execute a License Agreement with the Bayside. District Corporation (BDC), for use of City-owned property at -1324 and 1326 5th Street, for a seasonal ice skating program, from October 1, 2009 through February 15, 2010. Executive Summary For the last two years BDC has transformed a portion of the City's property located at 5th Street and Arizona Avenue, into an ice skating rink as part of its Winterlit holiday celebration. In 2008, the event attracted approximately 56,000 paid skaters. This year, BDC is again requesting a license from the City to use the property from October 1, 2009 through February 15, 2010. The ice skating rink is projected to be open to the public beginning October 30, 2009 and close January 18, 2010. BDC is negotiating a new management and operating services contract with an operator who will provide insurance in an amount required by the City's Risk Manager. Discussion BDC is negotiating aturn-key operation for an ice rink during BDC's upcoming Winterlit celebration. The ice rink is to be located at 1324 5th Street, from October 1, 2009 through February 15, 2010. Skating is estimated to begin October 30, 2009, and conclude January 18, 2010, operating from 10 am to 10 pm Sunday through Thursday, and 10 am to midnight on Friday and Saturdays. BDC expects to serve over 60,000 skaters with a program that includes casual skating, skating lessons, sale of skating- related souvenirs and merchandise, food and drinks and entertainment. BDC will be offering special programs for the Santa Monica Boys and Girls Club, PAL, YMCA, and other community groups. BDC's goal for the program is to be as energy efficient as possible and will continue to purchase renewable energy from the City. This year BDC plans to add a smaller ice rink of approximately 400 sq. ft., just for young children to test a more energy efficient technology. If this technology proves workable, BDC may use it in next year's main rink. In addition, all the decorative lights will be LED. Currently, Parking Valet Services manages the parking on the site and pays the City monthly rent of $6,000 under amonth-to month license agreement. The company will be given notice to vacate the site 30 days in advance so that those who park on the lot can make other arrangements. In accordance with Section 3 of the Services Agreement between the City of Santa Monica and Bayside District Corporation, executed December 3, 2004, the BDC is responsible for promoting and continued economic revitalization of the Downtown as well as programs, projects, and services that benefit Santa Monica residents, Downtown merchants, property owners, customers and visitors. The management of the ice skating rink program is consistent with the roles and responsibilities of the BDC. Financial Impacts & Budget Actions There is no budgetary impact as the FY 2009-10 Budget anticipated the return of the ice rink and the resulting foregone revenue of $30,000.
