SUBJECT: Appeal - Tentative Tract No. 36671, 36 Unit Condominium
Conversion for 305 San Vicente Boulevard, R4
Introduction
This .report transmits an application from Joseph A. Lyons from
the determination of the Planning Commission's denial of a Tenta-
tive Tract Map for conversion of an existing apartment house to
condominiums.
Background
On November 20, 1978 the applicant filed a Tentative Tract Map

vard,to condominiums. The application came before the Planning
Commission on April 2, 1979, was opnosed by a number of the tenants
and continued to April 16th for further action. On April ~.oth
the matter was continued to iday 2nd at which time it was denied
following further opposition by enants and subsequently ap-
pealed to the City Council.
Alternatives
Under State and local subdivision procedures, the City Council
comprises the appeals body in the case of condominium applications
and may affirn, reverse or modify any determination of the Planning
Commission. The determination of the City Council is final.

The Council may therefore deny the appeal and uphold the
determination of the Planning Commission or grant the appeal
and overrule the Planning Commission's decision.
The Council could also grant the appeal, adding such require-
ment as they may believe indicated.
Recommendation
Inasmuch as the Planning Commission has carefully considered the
application on two occasions including public comments on both
occasions and determined that the proposed conversion should not
be approved, it is respectfully recommended that the appeal. be
denied and the decision of the Planning Commission be upheld.
