A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING THE AMOUNT OF FEES TO BE
CHARGED FOR THE USE OF COMMUNITY
AND RECREATIONAL FACILITIES OPERATED BY THE
COMMUNITY AND CULTURAL SERVICES DEPARTMENT
OF THE CITY OF SANTA MONICA, FOR THE RENTAL
OF CIVIC AUDITORIUM PARKING SPACES, AND FOR
THE USE OF BEACH PARKING LOTS AND A DEFINITION OF
FACILITY USER CATEGORIES
WHEREAS, the municipal facilities managed by the Community and Cultural
Services Department of the City of Santa Monica are for use by the public; and
WHEREAS, it is the policy of the City of Santa Monica to charge for the use of
City facilities when such use benefits individuals rather than the community as a whole;
and
WHEREAS, the Santa Monica Municipal Code authorizes the City to establish
user fees for services, for opportunities provided by the City to individuals rather than
the general public; and for commercial and other uses of public property by individuals
and groups, and further authorizes setting the amount of such fees by resolution; and
WHEREAS, the City has calculated the cost of making various facilities available
for use by individuals and groups; and

WHEREAS, the City makes various recreational facilities, fields, courts, parking
lots, swimming pools, rooms, auditoriums, and patios, which are sited in City parks,
Santa Monica beach and other locations available for recreational activities and events
pursuant to City guidelines; and
WHEREAS, the City makes plots in the. community gardens available for
individual use; and
WHEREAS, the City makes rooms at the Ken Edwards Center available for
various types of meetings; and
WHEREAS, fees for use of City recreational facilities by the Santa Monica Malibu
Unified School District and the Santa Monica Community College are established by
separate facilities agreements between the City and those entities; and
WHEREAS, it is the policy of the City to establish its user fee schedules so as to
promote use of its limited facilities by this community and by groups working to promote
this community's welfare;
WHEREAS City recreational facility users are further defined in the Facility User
Categories listing shown in Exhibit G,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

SECTION 1. Facility rental fees for use of facilities located in City parks and at
the Ken Edwards Center shall be as specified in Exhibits A and B which are attached to
and are part of this Resolution.
SECTION 2. Fees for the rental of sports facilities shall be as specified in Exhibit
C which is attached to and is part of this Resolution.
SECTION 3. Permit fees for filming and photography in Ken Edwards Center,
buildings and sports facilities in City parks, at Santa Monica State Beach, and in beach
parking lots shall be as specified in Exhibit D which is attached to and is part of this
Resolution. Additional beach filming permit information is specified in Resolution 9862
(CCS).
SECTION 4. Fees for rental of the Santa Monica Swim Center pools and
meeting room shall be as specified in Exhibit E which is attached to and is part of this
Resolution.
SECTION 5. The City of Santa Monica has garden plots that are licensed to
Santa Monica residents only in accordance with conditions set forth in the Community
Gardens License Agreement, on an annual basis at a rate of $60 per year. License
Agreements are valid January 1 -December 31.
Gardeners licensed plots for a partial year will pay the following:
1. $60 if licensed January -March
2. $45 if licensed April -June
3. $30 if licensed June -August
4. $15 if licensed September -December

SECTION 6. The fee for renting available Civic Auditorium parking spaces shall
not exceed Seven Dollars and Twenty-Seven Cents. ($7.27) per automobile space per
period of occupancy, not to exceed twelve (12) hours. Parking for Auditorium events
shall have precedence over parking for the general public, including City employees.
Notwithstanding any provisioris contained herein, the City may grant free use of said
parking spaces to the general public.
SECTION 7. Beach parking lots may be rented for community events as follows:
2030 Barnard Way lot: 1/6 of the lot
1/3 of the lot
2600 Barnard Way lot: 1/6 of the lot

SECTION 8. The fee for use of volleyball courts at Santa Monica State beach for
volleyball tournaments is $500 per day.
SECTION 9. Permits for Miles Memorial Playhouse shall be granted according to
the priority usage categories listed below:

1. City of Santa Monica Cultural Classes.. Workshops, Activities and
Productions
The City of Santa Monica offers a range of cultural classes, workshops, activities
and productions for youth (defined as toddler through college age).
Programming must be appropriate and accessible for these age ranges and meet
the goal of offering culturally diverse programming. These classes, workshops,
activities and productions are offered in conjunction with the Department of
Community and Cultural Services. Rental fees are not applicable.
2. Non-Profit Organizations
This category consists of organizations with a documented 501(c)3 non-profit
status that provide unique cultural programming geared toward the target youth
audience as defined in category 1 above.
3. General Use Guidelines
Miles Playhouse permits are limited to performances with associated production
rehearsals and other approved cultural activities: Organizations may charge a
fee to the public to assist with costs of production. User groups must comply with
the application process and follow all rules and regulations regarding facility use.
Other criteria for evaluating and approving applications for potential user groups
are as follows:
- Groups must be financially sound and able to independently market the
approved event or program
- Groups must provide sufficient staffing and organization to fully implement
the approved event or program
- Groups must have a documented, proven track record

SECTION 10. Fees for the rental of the Miles Memorial Playhouse shall be as
specified in Exhibit F, which is attached to and is part of this Resolution. Fees to be
charged for use of the Miles Memorial Playhouse which are not included in Exhibit F
shall be determined by the Community and Cultural Services Director based upon the
costs incurred in providing the facility or program.
SECTION 11. Organizations using City recreational facilities may be charged
additional fees beyond those listed on the attached Exhibits when:
1. Use of the facility by any organization requires facility coverage or
maintenance beyond that normally provided.
2. Use of the facility results in damage to the facility interior, exterior or its
furnishings.
SECTION 12. Fees to be charged for the use of community and recreational
facilities but which are not listed in this Resolution shall be determined by the
Community and Cultural Services Director and shall be based upon the costs incurred
in providing the facility or program.
SECTION 13. The charges and rental rates set forth in this resolution shall also
be subject to Consumer Price Index (CPI) increases each subsequent July 1st when
noted on attached exhibits. The CPl increase factor shall be the annual rate increase
from February to February of the Los Angeles-Anaheim-Riverside Consumer Price
Index for Wage Earners and Clerical Workers published by the United States
Department of Labor, Bureau of Labor Statistics except that any such administrative

revision shall not be less than any annual cost of living adjustment provided to the
employees of the City of Santa Monica through Memorandums of Understanding
entered into between the City and the employees' bargaining representatives for the
comparable fiscal year, but in no event shall the annual administrative revision be less
than zero percent (0%).
SECTION 14. Effective July 1, 2009, Resolution Number 10310 is hereby
repealed.
SECTION 15. The fees set forth in this Resolution shall be effective July 1,
2009.
SECTION 16. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.

1. The Artifcial Turt Sfaffng Fee at Airport Park will continue to be waived far SM Public Schools (K - 12). For FY 2009-
10, the fee will be waived for organized youth sports groups meeting the Santa Monica residency requirement of 60%
residents far the season where registration had already occurred as of July 1, 2009. For the next season's registration, the
staffing fee will increase to $22.80.
2. The current Artifcial Turt Staffng Fee of $20 at Airport Park will remain in effect in FY 2009/10 for the non-resident
organized youth sports groups for the season where registration had already occurred as of July 1, 2009. For the next
season's registration, the staffing fee will increase to $22.80 + any applicable annual administrative increase.
3. The $22.80 Artificial Turf Staffing Fee will be effective 7/1/09 at Airport Park for all other groups or individuals permitting
the felds.
4. The $22.80 Artificial Turt Staffing Fee at JAMS will be waived for all organized youth sports groups for the FY 2009-10
season where registration hatl already occurred as of July 1.2009. For the next season's registration, the staffing fee will
increase to $22.80 + any applicable annual administrative increase.

non-profit status. These groups provide a range of human services, education and
recreational programs and events to Santa Monica residents. They may serve the
general public or .special user groups such as seniors, youth, or persons with
disabilities. These programs may be free, or attendees may pay a fee for service, a
membership fee or a voluntary donation. To be in this user category, applicants must
submit documentation of their tax-exempt status. This category also includes
governmental agencies. Insurance as determined by the City's Risk Manager may be
required.
Non-Sarita Monica-based Non-Profit Groups/Organizations (Fee Category B)
These users meet the definition of User Fee Category A, however are not based in
Santa Monica
Santa Monica-based Community Groups and Individuals (Fee Category C)
Informal community groups or individuals that do not have tax-exempt non-profit status
and are not a business entity but provide community .services or citizen participation
opportunities to Santa Monica residents are. in this category. These events may be
meetings, social events or educatiorial or recreation activities. Events and meetings. are
either offered free or an unspecified voluntary donation may be requested to cover the
costs of the event or meeting. Insurance as determined by the City's Risk Manager may
be required.
Non-Santa Monica-based Community Groups and Individuals (Fee Category D)
These users meet the definition of User Fee Category C, however they are not based in
Santa Monica or are not Santa Monica residents.

Santa Monica-based Business Entities (Fee Category E)
Businesses wishing to use a recreation building for employee training, meetings,
retreats, social or recreational activities are in this category. Attendees are not charged
an admission fee or fee for service and donations are not accepted. Insurance as
determined by the City's Risk Manager may be required. Santa Monica business license
shall be required.
Non-Santa Monica-based Business Entities (Fee Category F)
These users meet the definition of User Fee Category E, however they are not based in
Santa Monica and do not need a Santa Monica business license.
KEN EDWARDS CENTER (KEC) USER CATEGORIES (see Exhibit B)
Non-Profit Organizations (Fee Category A)
501(c)3 or 501(c)4 non-profit community-based organizations, that are funded through
the Community Development Program, Cultural Arts Organizational Support Grant
Program, or CO-Arts Grant Program of the City of Santa Monica; plus approved Santa
Monica neighborhood groups are allowed use of the KEC at no charge for 300 meeting
hours each fiscal year. Agencies using more than 300 hours during any fiscal year will
be charged the non-profit rental fee for those hours over 300. Other 501(c)3 or 501(c)4
non-profit human services organizations meeting the human services needs of Santa
Monica residents but not funded directly by the City are charged the non-profit rate as
indicated in Fee Category A. Insurance as determined by the City's Risk Manager may
be required.
Non-Profit Senior Service Organizations (Fee Category B)
Non-profit organizations with 501(c)3 or 501(c)4 status, not funded by the City of Santa
Monica, that provide senior programming consistent. with the City's Human Services
Division and meet the needs of Santa Monica's senior citizens are in this category. To

encourage a full range of senior services, these organizations shall be given a reduction
in the non-profit fee when utilizing the Senior Nutrition Room (100A,6) on the ground
floor of KEC. When using other areas of the KEC, these organizations shall be charged
the non-profit rental fee for the use of the KEC (see Fee Category A). Insurance as
determined by the City's Risk Manager may be required.
Community Groups (Fee Category C)
Those organizations without 501(c)3 or 501(c)4 status convening meetings with a focus
on human service issues that will benefit low and moderate-income Santa Monica
residents are included in this category. These meetings are free of charge and open to
the public. An unspecified voluntary donation may be collected to cover the costs of
having the meeting. Such groups are charged the community groups rental fee (Fee
Category C). Non-profit organizations conducting fund raising events are also in this
category. Insurance as determined by the City's Risk Manager may be required.
Filming (See Exhibit D)
Companies or individuals desiring to take still or motion pictures in Ken Edwards Center
are in this category. A film permit must be obtained from the City of Santa Monica in
addition to a Ken Edwards Center rental permit. Insurance as determined by the City's
Risk Manager may be required. .
SPORTS FACILITIES USER CATEGORIES (see Exhibit C)
Youth Sports Groups.
Community-based athletic organizations or sports groups with multiple teams and an
established program that provides a continuum of opportunities to ensure diversity of
users or the full range of skill levels are in this category. Groups must demonstrate that
60% of their participants live in Santa Monica to receive the resident rate. Insurance as
determined by the City's Risk Manager may be required.

the general public or special user groups such as seniors, youth, or persons with
disabilities. These programs may be free, or attendees may pay a fee for service, a
membership fee or a voluntary donation. To be in this user category, applicants must
submit documentation of their tax-exempt status. Insurance as determined by the City's.

Sports groups/teams who do hot qualify as a Youth Sports Group, and individuals
desiring use of a sports facility are in this category. Programs are either offered free or
an unspecified voluntary donation may be requested to cover costs: Groups/teams
requesting seasonal permits must demonstrate that 60% of their participants live in
Santa Monica to qualify for the Santa Monica resident rate. Insurance as determined by
the City's Risk Manager may be required.
Camps
Organizations conducting youth or adult sports camps are in this category. A voluntary
donation or fee for service may be requested to cover costs. Insurance ss determined
by the City's Risk Manager may be required. Camps must be based in Santa Monica to
receive the resident rate.

this category. A filming permit must be obtained from the City of Santa Monica in
addition to a facility rental permit. Insurances as determined by the City's Risk Manager

SANTA MONICA SWIM CENTER (see Exhibit E)
Permits for the Santa Monica Swim Center shall be granted according to the priority
usage categories listed below:
1. City Programs
The City of Santa Monica offers a range of sports programs for youth, adults and
persons with disabilities. These programs are offered by the Community and Cultural
Services Department which .has first priority use of the Swim Center. Rental fees are
not applicable.
2. Santa Monica College (SMC)
SMC offers a range of sports programs for students that may utilize the Swim Center.
Schedule, fees and fee waivers shall be based on a separate facility agreement
between the City and SMC._
3. Santa Monica-Malibu Unified School District (SMMUSD)
The SMMUSD offers a range of sport programs for students that may utilize the Swim
Center. Schedule, fees and fee waivers shall be based on a separate facility agreement
between the City and SMMUSD.
