R-10403City Council Meeting 6-23-09 RESOLUTION NO. 10403 (CCS) (CITY COUNCIL SERIES) Santa Monica, California A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA ESTABLISHING AN ANNUAL ADJUSTMENT TO FEES AND AMENDING PRIOR RESOLUTIONS THAT ALLOW FOR THE ANNUAL ADJUSTMENT TO FEES WHEREAS, the City of Santa Monica has established a comprehensive schedule of City fees, including user fees and permit fees; and WHEREAS, the City's study of its fees demonstrates that in many instances the full costs of City services charged to particular individuals are not being paid by those individuals because the fees charged by the City for user fees or permits are often set Tower than the actual full costs of the City to provide such services; and WHEREAS, Santa Monica Municipal Code section 2.72.020 allows fees to be set either by ordinance, by a resolution adopted by the City Council, or by any other means authorized by law; and WHEREAS, through the adoption of various resolutions the City Council has established user fees or fees for services and in these resolutions the City Council has provided for the annual adjustment of such fees; and 1 WHEREAS, the City desires to preserve public resources by ensuring that the annual adjustment to fees does not result in City fees being set lowerthan actual City costs and expected City cost increases, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. Commencing on July 1, 2009 and on July 1 of each fiscal year thereafter, all fees, including user fees and permit fees, established by any resolution of the City Council, that are subject to annual adjustment, shall be administratively revised and increased annually by a factor equal to the difference in the Los Angeles-Anaheim- Riverside Consumer Price Index for Wage Earners and Clerical Workers forthe twelve (12) month period February through February of the prior fiscal year, except that any such administrative revision shall not be less than any annual cost of living adjustment provided to the employees of the City of Santa Monica through- Memorandums of Understanding entered into between the City and the employees' bargaining representatives for the comparable fiscal year, and in no event shall the annual administrative revision be less than zero percent (0%). SECTION 2. This Resolution amends Resolutions 9670 (CCS), 10361 (CCS), 10322 (CCS), 10142 (CCS), and 10372 (CCS) as well as any other resolution of the City Council of the City of Santa Monica that sets forth and allows for an annual administrative revision of City fees. 2 SECTION 3. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
