Conversion, 1114 - 12th Street, Joanne Levey, Appellant
Introduction
This report transmits an Appeal of the Planning Commission's
approval of a subdivision for condominium purposes to convert
an existing apartment building to condominiums.
Background
In April the owner of a 23 unit apartment filed a Tentative
Tract Map for conversion of the apartments to condominiums. The
building is seven years old and provides 12 parking spaces per
unit thereby qualifying it for conversion under the City's Condo-
minium Conversion Ordinance. On May 15, 1978 following a Public
Hearing, the Planning Commission approved the application by'a
vote of 6 to 1. On May 30, 1978 Joanne Levey, a resident of the
building,appealed the Planning Commission's action on behalf of
the Tenants Committee 'of 1114 - 12th Street. A copy of the let-
ter of appeal setting forth the reasons for the appeal is attached.
Alternatives
Under the Santa Monica Subdivision Ordinance and the State Map
Act the City Council may affirm, reverse or modify any determination
of the City Planning Commission in regard to a subdivision for
condominium purposes. The City Council, therefore, has the alter-
natives of reversing the Planning Commission's action by granting

the Appeal, affirming the approval or modifying the Commission's
decision by granting the Appeal with such conditions as the City
Council may believe .indicated.
Recommendation
The building under consideration meets the requirements for
conversion under the Santa Monica Condominium Ordinance. The
application was approved by the Planning Commission with the
stipulation that there would be no age restrictions on occupancy
of the building. The State Map Act requires that tenants be
given 120 days notice o£ termination and 60 days right of first
refusal on the unit that they occupy. In view of the unanimous
Planning Commission action and the above, it is respectfully
recommended that the City Council affirm the Commission's determi-
nation.
