SUBJECT: Appeal, Tentative Tract No. 35120, New 6 Unit Condo-
minium, 948 - 19th Street, Maria La Place, Appellant
Introduction
This report transmits an Appeal from the determination of the
Planning Commission on a subdivision for condominium purposes.
Background
The applicant, Emery Wong, owns a lot at 948 - 19th Street upon
which he proposes to build six 3-bedroom townhouses estimated to
sell for $105,000 to $150.,000. At the time the matter was con-
sidered by the Planning Commission on May 15th, the property was
developed with four 1-bedroom units which have subsequently been
removed. At the hearing the application-was opposed by two
tenants of the building, by Syd Rose representing the Santa Monica
Committee for Fair Rents and a petition of 100 signatures pro-
testing the demolition of the structure. The appellant, Maria

On May 5, 1978 the matter was appealed by the Legal Aid Founda-
tion of Los Angeles on behalf of Maria La Place and the Santa
Monica Committee for Fair Rents. The City Attorney's office
ruled that the Committee did not have legal standing to appeal
but that Maria La .Place, as a displaced tenant, would have.
Alternatives
The Santa Monica Subdivision Ordinance and the State Map Act
provide that the City Council may affirm, reverse or modify any
determination of the City Planning Commission in the matter of
a tentative tract map. In this case, however, the Planning Cam-
mission took no official action and the appeal. is against the
map being approved by operation of law rather than action of
the Commission. The Council may therefore approve, deny or modi-

Recommendation
The proposed structure meets cr exceeds ail State and local re-
quirements and in view o£ the existing housing having been vacated
and removed, it is respectfully recommended that the project be
approved with the original staff recommendation that the front
driveway be eliminated.
