SR-04-24-1979-7E7~ Santa Monica, California, April 18, 1979 TO: The Mayor and City Council FROM: The City Staff APR 2 4 1979 SUBJECT: Appeal, Tentative Tract No. 36646, 11 Unit Condominium Conversion, 3219 Colorado Avenue, R2, Sotiri Anastasiadis Introduction This is an appeal from the determination of the City Planning Commission in denying a Tentative Tract Map for a condominium conversion. Background On December 20, 1978 the applicant filed a Tentative Tract Map to convert a 4 year old 11 unit apartment to condominiums. The matter came before the City Planning Commission on March 19th for consideration and following a public hearing it was opposed by several tentants-and was denied partially on the basis of lack of tenant notification. The vote to deny was 5 to 1 with one absence. It was subsequently discovered that failure to notify the tenants of the hearing was the fault of the Planning Depart- ment rather than the applicant and the matter was submitted to the Planning Commission for possible reconsideration on April 2, 1979. At this meeting a motion for reconsideration lost for lack of a second leaving the previous denial in effect. The applicant has now appealed to the City Council. Alternatives The Santa Monica Subdivision Ordinance provides that the City Council may affirm, reverse or modify any determination of the APR 2 4 1979 Mayor and City Council - 2 - April 18, 1979 Planning Commission in the matter of a Tract for subdivision purposes. The Council may therefore grant the appeal and over- rule the Planning Commission or deny the appeal and let the Commission's determination stand. Recommendation The Planning Commission's decision of April 2, 1979 not to re- consider clearly indicates that the lack of tenant notice was not of such substantial importance in their decision that the ap- lication should be denied as to warrant further consideration.
