SR-04-24-1979-7BSanta Monica, California, April 18, 1979 TO: The Mayor and City Council APR 2 ~ 1979 FROM: The City Staff SUBJECT: Appeal, Tentative Tract No. 36627, 5 Unit Condominium Conversion, 1452 Harvard Street, R2, Roscoe Webb, Jr. Introduction This is an application from the determination of the Planning Commission to deny a permit for a condominium conversion. Background On December 19, 1978 the appellant filed a Tentative Tract Map to convert a 6 year old 5 unit apartment to condoriiniums. The matter came before the Planning Commission on March 19th for consideration and following a public hearing was denied due to inadequate parking and trash areas. The denial was by unanimous vote by the 6 members present. The matter has been appealed to the City Council. Alternatives Under the Santa Monica Subdivision Ordinance the City Council may affirm, reverse or modify the determination of the Planning Com- mission in the matter of a Tentative Tract PQap for subdivision purposes. The Council may therefore grant the appeal and reverse the Planning Commission or deny the appeal and let the decision of the Commission stand. Recommendation Inasmuch as the State Map Act and the City's Condominium Ordinance APR 2 4 ;gig Mayor and City Council - 2 - April 18, 1979 provide that the Planning Commission shall review and approve a condominium project as satisfying certain minimum require- ments in design, and the Planning Commission having reviewed the proposed project and found it to be unsatisfactory by rea- son of parking and trash area,_it is respectfully recommended that the appeal be denied and the decision of the Planning Com- mission upheld.
