SR-03-27-1979-7ASanta p4onica, California, March 14, 1979 TO: Mayor and City Council PAAR 2 7 1979 FROM: City Staff SUBJECT: Appeal Tentative Tract Map No. 36447, 9 Unit Condominium Conversion, 837 - 10th Street, R3, W & J Renner Introduction This is an appeal from the Planning Commission's denial of an application for a Tentative Tract Map for a condominium conversion. Background The applicants own a 12 year old 10 unit apartment with 11 parking spaces at 837 - 10th Street in the R3 District. On November 17, 1978 they filed a Tentative Tract Map to convert the apartment to condominiums. In order to meet the minimum parking requirements for conversion they propose to add three additional parking spaces and reduce the units from 10 to 9 by combining two 1 bedroom units into a large 2 bedroom unit. Tr7ith 14 parking spaces and 9 units the building qualifies under the City's Condominium Conversion Ordinance as a Category II structure in that 12 parking spaces per unit were provided. The revised parking plan which contains no tandem spaces was approved as ac- ceptable by the Traffic Engineer. On March 5, 1979 the Planning Commission denied the application on the basis that two of the new parking spaces situated at the end of the parking aisle required that the cars back out the MAR 2 ?-1979 Mayor and City Council - 2 - March 14, 1979 entire length of the building and onto 10th Street. The motion to deny was approved by a 4 - 3 vote. The applicants have ap- pealed this decision to the City Council. Alternatives Under Section 9314 of the Santa P4onica Subdivision Ordinance the City Council may over-rule or modify any ruling or determination of the Planning Commission in regard to any subdivision. The City Council therefore has the alternatives of determining that the proposed parking plan is unacceptable and deny the appeal or that the parking plan is acceptable and grant the appeal thereby over-ruling the Planning Commission. Recommendation In the absence of any indication that the action of the Planning Commission in disapproving the proposed parking design was unrea- sonable, arbitary or not in accordance with established ordinances, it is respectfully recommended that the determination of the Plan- ning Commission be upheld and the appeal denied.
