SR-10-24-1978-8DCA RLK:AMK: _0/19/78 Santa Monica, California October 19, 1978 TO: Mayor and City Council ~T 2 4 197 FROM: SUBJECT: Introduction City Attorney Proposed Parcel Map Ordinance This report transmits for first reading a proposed ordin- ance establishing procedures for filing parcel maps and waiving thE: requirement for parcel map in specified circumstances. Background The preparation and filing of parcel maps, tentative maps and final subdivision maps is governed by the State Sub- division Map Act {Calif. Govt. Code Section 66410 et seq.) Re- cent amendments to the Map Act impose the requirement of a parcel map on all subdivisions where a tentative and final map are not otherwise required by the Subdivision Map Act. In most instances, the parcel map requirement for developments in Santa Monica thus arises only in conjunction with the subdivision of property into four or fewer lots for condominium purposes or occasonallot splits. The relevant amendments to the Map Act further require that each locality shall adopt procedures for the processing of parcel maps ar:d the waiver of said requirements when a finding can be made that the proposed development meets all requirements of the City Code and Subdivision Map Act. The Map Act also pro- vides that the requirement of written consent to the filing of parcel maps from all record title owners may be varied by local ordinance. The attached ordinance establishes the requisite proce- dures, granting primary authority and responsibility for review and approval of parcel maps to the Zoning Administrator, with appeal to the Planning Commission and, therefrom, to the City Council. The Zoning Administrator is further granted the author- ity to make the preliminary discretionary decision with regard to waiver of parcel map requirements when his preliminary review establishes full compliance with local and state codes, minimiz- ing the present heavy burden upon the Planning Commission and Council for subdivision review and eliminating unnecessary ex- pense for the subdivider. The attached ordinance also sets forth the exceptions in the Map Act with regard to the require- ment for written consent concerning all recorded interests in the property and establishes an additional exception for prop- erty involved in eminent domain proceedings with a public agency. Adoption of an ordinance in substantially the attached form is required under State law, with local discretion con- fined to the specific procedures and exceptions delineated therein. Alternatives To adopt the attached ordinance or modify the specific terms thereof with regard to procedure, responsibility and exceptions to the requirement for certificates of consent to record a parcel map. -2- CA RLK:AMK: --- 1.0/19/78 Recommendation It is respectfully recommended that the City Council accept the attached ordinance for first reading and hold a public hearing.
