FROM: Business License Review Committee SUBJECT: Recommended Modifications o£ Business License Ordinance The Business License Review Committee, pursuant to City Council instructions during budget study sessions, reconvened on October 10, 1962, for the purpose of hearing protests and complaints concerning the recently adopted ordinance. These recommended modifications resulted from this hearing. Two notices of this hearing were sent to the following persons or organizations: 1. Santa Monica Chamber of Commerce, c/o Sam Porter, Manager 2. Santa Monica Bay District Board of Realtors, c/o David Houtz, President 3. Santa Monica Evening Outlook, c/o Deane Funk, General Manager 4. Mr. James O'Brien, Resident Manager, Paine, Webber, Jackson and Curtis 5. Mr. William A. Wagner, Atlas Scale Company 6. Municipal License Tax Association, c/o Mr. B. E. Nelson 7. Santa Monica Bay Area Apartment Owners Association, c/o Perry Johnson No representative of either the Chamber of Commerce or the Board of Realtors appeared at the hearing. The others were represented by speakers. The complaints heard can be briefly summarized. The Municipal License Tax Association objected to linen supply trucks being licensed at $50 per year when other retail delivery trucks are licensed at $25 per year. The Association, it should be noted, represents retail delivery firms and stated the $25 fee was proper. The Association objected that the window decal provision (Section 6119) was contrary to prevailing California law. The Apartment Owners Association objected to a fee on automatic washing machines since the machines are a convenience to apartment dwellers and not truly a "business" of the apartment owner. Webb Service Company, a machine con- tractor, objected to the high rate and suggested a gross receipts formula be devised. Representatives of two weight scales companies provided facts which indicated the weight scale fee was exhorbitant. Mr. O'Brien stated that a gross receipts (Section 6240) formula for brokerage houses seemed reasonable. One manu- facturer appeared and requested information, but had no protest. The City Clerk raised several administrative problems for committee consid- e ration. After hearing these complaints and holding a discussion, the following motions were adopted: ~ "That the fee for linen supply be reduced from $50 to $25 per truck per annum {Section 6211E) ~~~, ~<..ya~J' ~~.~~ , 2. "That there be no change in Sections 6225, 6226 and 6227, i. e. gross re- ceipts for retail merchants, wholesalers or manufacturers. "That 'Stocks and Bonds, Brokerage Houses and Firms' be included under ~,f Section 6240, i. e. gross receipts for services. .r "That Section 6236-(40), i, e. Real Estate Brokers, remain unchanged. {~ - ~; ~" -!'That the maximum license fee for Section 6240--Services, be $i, 500, he same as for retail merchants. _ ~~' "That the fee for weight scales be reduced from $2. 00 to $. 50 per machine . per annum (Section 6247E) , t ~C ,~~ i~ ., ~ , ~/ "That the third paragraph of Section 6204F be deleted and the following substituted: The licensee or his agent shall employ the number of police officers deemed necessary by the Chief of Police to properly preserve the public health, peace and safety in said dance hall during the hours said dance hall is open. Each police officer so engaged shall be paid the maximum prevailing wage for specsal work as established in the Salary Resolution adopted by the City Council. Said police officers shall be under the direction and control of the Chief of Police. " It should be noted that Sections 6204F and 6212E were modified because of administrative problems. The suggestion was made, also, to include real estate salesmen and agents under Section 6236-(40), so that persons engaged in this business would be required to pay $25 per annum. The matter was not acted upon since the Board of Realtors was not present. The Committee was of the opinion that this matter and the feasibility of using a gross receipts formula for investment firms, i, e, savings and loans, etc. should be con- sidered at some future review. This report is hereby transmitted with a recommendation that the business license ordinance be modafied in accordance with the motions contained herein. This office concurs with the Committee in its findings and recommendations. If the Council favors these recommendations, the City Attorney should be instructed to draft the appropriate ordinance.
