As you know, the City Council, at its meeting of February 11, 1864 (Item 8-E}, authorized the issuance of a permit to Mr. Brandon O'Hildebrandt for the construction of an underground parking structure under a portion of Arizona Avenue adjacent to his proposed building, said permit to be subject to certain terms and conditions. One of the conditions precedent to the permit was that the entrance to said underground parking structure must be from Arizona Avenue and must be at least five feet from that alley (First Court}. This condition was imposed in order to provide the maximum safety to pedestrians using the sidewalk on Arizona Avenue, since it would provide for an,adequate curb face between the alley and the driveway and thus prevent a car from cutting diagonally across the sidewalk in going to or from the garage. This requirement (not allow- ing a driveway to encroach into a curb return} has been City policy for many years. Mr. O'Hildebrandt has been aware of this condition since the inception of the project and in previous discussions has inter- posed no objection to it. Nevertheless, when his plans were submitted to the City for checking a short time ago they provided for only two feet between the alley and the driveway, thus making it impossible to provide adequately for pedestrian safety as outlined above. Mr. O'Hildebrandt has informed me, after checking with his engineer, that it is not now econornically feasible to change the design of the structure to comply with the five foot clearance condi- tion set forth in the application for permit. He has requested that this requirement be waived. Since the original condition was approved by the City Council, Mr. O'Hildebrandt was informed that any change in said conditions could only be authorized by the City Council. BARTLETT L.
