THE ENCROACHMENT CONSISTS OF A RETAYNING WALL 32 INCHES
HIGH, ENCROACHING ONTO PUBLIC PROPERTY 9 INCHES FOR A
DISTANCE OF 45 FEET.
THE RECOMMENDATION AGAINST ENCROACHMENT IS MADE BECAUSE
THERE IS NO VALID REASON FOR CONSTRUCTING THE WALL IN
THAT PARTICULAR LOCATION AND WILL PRESENT NO HARDSHIP
TO THE OWNER TO RELOCATE AS IT HAS NOT BEEN BUILT, ONLY
FORMED.
