When the State acquired a portion of the Pico
Boulevard frontage of Lot 254, Traet 1880 (Southeast
corner of Pico and 34th Street) by condemnation for
Freeway purposes on October 3, 1963, there was an error
in the legal description and the strip was one foot
narrower than what they thought they had acquired. When
the street and sidewalk in this area was constructed by
the State they built to what they believed tivas the
property line, with the result that the sidewalk
encroaches one foot more or less onto private property.
When the State relinquished - by quitclaim -
this street and sidewalk to the City, they relinquished
the full width - more than they had acquired. The
relinquishment included the property to the back of
sidewalk as constructed by the State - approximately one
foot along Pico Boulevard and two. feet along the corner
cut-off at 34th Street.
This sidewalk was completed approximately in
November, 1865 and has been in constant public use since
that time.
This office has received, by letter dated
May 16, lg6g (copy attached), a request from Host
International, Inc., owners of the property at this
location, for permission to encroach one foot into 34th
Street (the one foot strip between the back of walk and
the property line) in return for which they propose to
grant the City an easement along the Pico Boulevard
frontage to the extent of the existing sidewalk which
encroaches onto their property.

The above proposal appears to be in the City's
interest, from both the standpoint of eliminating a
maintenance problem as well as obtaining easement rights
to sidewalk now in public use,
It therefore is recommended that the City
Council be requested to authorize the encroachment on
34th Street, contingent upon Host International, Inc.
granting to the City an easement for sidewalk purposes
on Pico Boulevard as set forth in the attached letter.

Dear Mr. Kennedy:
We hereby request permission to encroach one (1) foot onto City-
owned property as per the attached application for a Building Encroachment
Permit, in return for which we propose to grant the City of Santa Nloriica
an easement of one (1) foot or so along the property line adjacent to Pico
Boulevard, to the extent of the existing city sidewalk encroaching onto our
property at the present time.
The proposed plans ca1_1 for a decorative security wall around the
perimeter of the property line, which would, if executed, reduce the width
of the existing sidewalk along Pico Boulevard, as well as restrict service
space for traffic signal at corner, while the one-foot strip between. the
sidewalk and fence at 34th Street would become a maintenance problem if
it were retained in the present form. Therefore, a favorable action on the
proposed solution would satisfy all conditions for botlx parties concerned.
