Pursuant to City Council instructions, this office has negotiated with
Brandon O'Hildebrandt on the terms and conditions of the subject permit.
ivSutual agreement has been reached on the following:
1. Duration of permit--one year from the date of execution.
2. Fee: $250 plus a sum calculated by means of the following formula:
Let x = area in square feet
y = appraised value of land per square foot
F = amount
Then:
F = 10% of xy
or
F = (.Ijxy
(Note--Assuming iVir. O'Hildebrandt requires the area previously
indicated, the total fee will approximate $12, 500. )
3. In the event the activities permitted are not initiated during the one
year period, the permit shall automatically lapse and the fee shall
be refunded except for the initial $250, which sum shall cover the
City's administrative costs.
4. Other costs shall be paid by 1~/1r. O'Hildebrandt and shall consist o£
the following (estimates only):
a. Relocation of an 8" water main in the Ocean Avenue
sidewalk $ 2, 000
b. Reconstruction of pavement, curbing, sidewalk and
appurtenances, based on the assumption that existing
improvements will be removed and that the new fill
will be brought to pavement subgrade elevation. $ 4, 500

5. O'Hildebrandt shall post a bond guaranteeing restoratian of any City
facilities damaged by his activities in this area, (Note--there are
sanitary facilities and other utilities in First Court. )
6, A minimum of five feet (5') of cover shall be provided ov°r the roof
of the underground area.
7. Said roof shall be designed to withstand highway loading.
8, The vehicular entrance and exit to the underground area shall be
located on Arizona Avenue, parallel to and at least five feet (5')
from First Court.
9. All fees, costs, etc. paid shall be exclusive of any possessory
interest or other ad valorem taxes levied against this property.
10. The property into which this encroachment extends is approximately
bounded by the Ocean Avenue curbline and extension thereof to a
point at the middle of Arizona Avenue, and thence along said middle
line to First Court. {Note--The City Engineer can furnish an exact
description, if necessary,)
If the Gity Council approves, the City lb?anager should be authorized to
execute an encroachment permit embodying these terms and conditions,
