SUBJECT: Encroachment Onto Sewer Easement - 516 and 518 Raymond Avenue.
The Kew Investment Enterprises have submitted building
plans for a 20 unit apartment house at 516-518 Raymond Avenue. Their
plans call for a retaining wall along the west and south property
lines. There also are footings and columns along the west property
line which support the beams that support the first floor. Parking
is being provided underneath the first floor.
41hen the plans were submitted to the Engineering Depart-
ment for checking, the developers were informed that the City has an
8-inch sewer line running along a portion of their south property line
and along the full length of the west property line. This 8-inch sewer
is located within a 10-foot wide easement, said easement being 5 feat
on their property, and the other 5 feet being on the adjacent property.
This easement is included in Easement Deed ;~81 (Commissioners
Series). Said deed reads in part as follows:
"It being understood that the undersigned, his heirs and
assigns will not erect any building on said strips or
interfere with the authorities of the City of Santa
Monica in constructing or placing of the works above
set forth.
"It being understood that said strips shall never be
used as a public highway."
Apparently the owneros Title Report did not disclose the
easement.
Attached is a plan (in 2 sheets) showing the existing situa-
tion and a possible solution approved by this department, It involves
locating the wall and footings 22 feet into the easement, but with
the footings designed so that the building load is not transmitted
to the sewer.
It is reconvnended that the suggested encroachment be approved,
and the developers be authorized to construct a retaining wall and
column footings in the above described 2z foot str~.p.

(commonly known as 518 .Raymond Avenue).
Gentlemen:
The City Council, at its meeting of August 12, 1969,
approved your request for permission to encroach a maximum
distance of two feet six inches (2t-&") into the sewer and water
easement described in Easement Deed #$1 (Commissioners Series),
recorded on March 10, 1gOg in Book 3627, page 23g of .Deeds,
Records of Los Angeles County.. Said encroachment is for the sole
purpose of constructing footings for steel columns and a five
foot high retaining wall.
The City Council's approval is conditioned upon the
owner of the property or its successors in interest being
responsible for damage due to any ground slippage attributable
to the weight of the building.
Please indicate your acceptance of the above condition
in the space below and return the original and one copy, both '
signed, to this office.
