SR-012709-4bCity Council Meeting: January 27, 2009 Agenda Item: ~ ~~ To: Mayor and City Council From: City Staff Subject: Resolution Declaring a Vacancy on the City Council Recommended Action Staff recommends that Council adopt the attached resolution declaring a vacancy on the City Council; that Council discuss the options and procedures to fill the vacancy, as provided for in Section 603 of the City Charter; and, give direction to staff. Executive Summary Section 603 of the City Charter states, in part, that a vacancy on the City Council shall be filled by appointment within thirty days after the office is declared vacant, and shall Council fail to fill the vacancy, Council shall forthwith cause an election to be held to fill such vacancy. This report recommends that Council adopt the attached resolution declaring a vacancy. Staff also recommends that Council open discussion regarding options and procedures to fill the vacancy, and give direction to staff. Discussion On January 7, 2009, Councilmember Herb Katz passed away after many years of devoted service to the City. The attached resolution declares Councilmember Katz' Council seat vacant in accordance with City Charter Section 603. Once the seat is declared vacant, Council has thirty days to fill the vacancy by appointment. If Council fails to fill the vacancy, Council shall forthwith cause an election to be held to fill the vacancy. 1 Financial Impacts & Budget Actions The recommendation presented in this report does not have a budget or fiscal impact. The financial impact for a Council appointment to fill the vacancy is negligible. If Council opts to call a special election staff will return with additional information including financial impacts.
