Penney Company Pursuant to your request, I am forwarding copies of the following documents: a. July 14, 1966--Application for tax credit executed on behalf of the Penney Company by NIr. Gulsrud. b. February 3, 1967--Notice of intention to correct deficiencies executed on behalf of the Company by Mr. Gulsrud. c. March 1, 1967--Notice of failure to comply. In addition to the foregoing written notices, a number of telephone conversations occurred between i'~/ir. Gulsrud and members of the staff. Between February 15 and March 31, Mr. Aronoff discussed with Mr. Gulsrud, on at least one occasion, sign compliance standards. .Early in 1~iarch, Mr. Ferris of this office also discussed with ivlr. Gulsrud the dimensions and location requirements for a conforming sign. In the latter instance the calls were initiated by Nir. Gulsrud. Prior to the week of April 4, the administration was not aware that the operators of the Penney parking lot had continued to charge for parking of one hour or less for each parker who did not produce a Penney's validation. It was called to our attention by numerous merchants on Third Street as well as members of the City Council. Accordingly, and as the Council was advised at the April 4 Council meeting, the credit previously allowed the Penney Company pursuant to their agreement to comply was withdrawn. Subsequent to the withdrawal of the credit, this office has been advised by Mr. Gulsrud that he personally was not aware that the parking lot attendants were charging for the first hour. He has also assured this office that the operators were properly instructed and that the acts of the operators were violations of his instructions and that other arrangements have now been made to assure complete compliance. Gulsrud has talked directly with the other retail merchants on the west side of Third Street between Arizona and tiYilshire, and has assured these merchants that the parking is available, that it is free for the first hour without validation or without charge. A number of the concerned merchants have called this office and indicated that they are satisfied with I~1r. Gulsrud's explanation and that they feel the Penney Company should not be penalized because of the actions of the parking lot operators which were contrary to the instructions received from A4r. Gulsrud. I do not believe tinis office has the discretion to restore the credit, short of specific instructions from the City Council.
