Introduction
This report transmits a Final Tract Map for a condominium conversion
for City Council consideration under a writ of mandate.
Background
On February 26,1979 the Tentative Tract Map was approved with the
condition that the rear garages be enclosed and that "no parking"
be stencilled in the turn-around area. On October 15, 1979 the
Final. Tract A1ap was filed by the County Engineer but was not placed
before the City Council because of the Council policy requiring
prior Rent Control approval.
On February 4, 1980 the Planning Commission. granted a one-year
extension on condition that the applicant seek approval of the
Rent Control Board prior to approval of the Final Map. The exten-
sion was appealed to the City Council and at the same time the
applicant requested approval of the Final Tract Map on t:ie basis
of the Council's change in policy regarding Rent Control approval.
On P4ay 13, 1980 the Council deferred action on the Final Map until
the conditions on the extension had been complied with. On Octo-

ben 14, 1980 the applicant obtained a writ of mandate orderingA ~e ~ ~"'
City Council to consider the Final Map.

Recommendation
In view of the fact. that all conditions of the Tentative have
been met and. the E1 Patio decision has negated the Planning Commis-
sion's requirement for Rent Control approval as a condition o£
extension, it is respectfully recommended that the Council approve
the Final Map.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MO'_QICA ACCEPTING AND APPROVING SUBDIVISION
MAP OF TRACT NO. 36421-AND DIRECTING ISSUANCE
OF CONDOMINIUM CONVERSION PERMIT ON CONDITIONS
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. The Map of Tract No. 36421 in the City'of Santa
Monica presented by John P. Y.orbakis, being a subdivision for
condominium purposes of Lot D, Block 35, Amended Mai of the Town of
Santa Monica as shown on Map recorded in Book. 39, Pages 45 to 51,
inclusive ,_ of Miscellaneous Records, Records of Los Angeles County,
is accepted and approved.
SECTION 2. The Building Officer is directed to issue a condo-
minium conversion permit for the. project described by this map,
pursuant to the provisions of Resolution 5572 (CCS), to be effec-
tive upon full satisfaction of the conditions precedent stated in'
Section 2 thereof.
SECTION 3. The adoption of this resolution does not relieve
the subdivider from compliance with ali Federal, State, and local
laws applicable to the project.
SECTION 4. The City Clerk'herebX is author}zed and directed
to endorse upgn the face of said .Map-this order authenticated by
the Seal of the City of Santa Monica.
SECTION 5. The City Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be
in full force and effect.
