Introduction
This is an appeal from the Planning Commission's denial of
an extension o£ a tentative map for a condominium conversion.
Background
The tentative map was originally approved :November 20, 1978
and a one-year extension granted on November 5, 1979 with
rent control approval as a condition of extension. On May
29, 1980 the owner's attorney requested a tolling of the time
for expiration of the tentative map under a government code
section providing for such tolling where a lawsuit is pending.
The request was eventually tabled. On October 28, 1980 a
further extension was requested to complete resolution of
court action with the Rent Control Board. The request was
denied by the Planning Commission and appealed 'by the owner.
Alternatives
Under the City's Subdivision Ordinance the City Council may
affirm, reverse or modify any action of the Planning Commission

Recommendation
Due to the Planning Commission's considered action, it is
respectfully recommended that the appeal be denied and the
determination o£ the Commission be upheld.
