SUBJECT: Final Map Approval
Introduction
This report transmits a Final Map for City Council approval of the following
condominium project which received Tentative Approval September 25, 1980:
TRACT ADDRESS DEVELOPER UNITS
37926 1855 and 1859 Ninth Street Luis Villalobos 12 (new)
Background
After public hearing and careful review of the record and staff recommendations,
the City Planning Commission approved the Tentative Map for the above project.
The action of the Planning Commission was based on its finding that the pro= - -
posed subdivision should cause no substantial environmental damage and is in
conformance with all state and local laws and regulations and applicable General
Plan Elements. The Final P4ap conforms to the Tentative Map. The License Division
reports that the developer has either paid or agreed to pay the condominium taxo
The Building and Safety and Fire Departments indicate that the project meets
present fire safety requirements. Approval by the County Engineer's offiee has
been received for the project.
Two `adoi,ning-lots at 1855 and 1859 Ninth Street were granted removal permits
as uninhabitable and an exemption as single-family dwelling, respectively, by
the Rent Control Board in the fall of 1979 and removed in that same year. The.
subdivider purchased the property June 24, 1980-and made a claim for a vested
right that was denied by the Council June 2, 1981. The developer had not obtained
a building permit and is working towards recordation of a final map and completion
of the project. ~/ A

1. Approve-the final subdivision map if the City Council finds that the final
subdivision map is in substantial compliance with the tentative subdivision
map.
Z Disapprove the final .subdivision map if the City Council finds that the
final subdivision map is not in substantial compliance with the tentative
subdivision map or if the City Council makes any of the findings set forth in
Government Code Section 66474.
Recommendation
It is respectfully recommended that the final map be approved unless the
Council makes the required findings for denial set forth in Section 66474 of
the Government Code.
