SUBJECT: Final Subdivision Map Approval for Tract Map
Number 36639 (6 units at 960 21st Street)
and Tentative Tract Number 36640
(7 units at 755 21st Street)
INTRODUCTION
On April 28, 1982, the City entered into a Stipulated
Judgment in settlement of Case No. WEC 67029, Vita
Markevicius v. City Council et al. The judgment requires
that the City approve the Final Tract Maps. At the same
time, the property owner, Vita Markevicius, cannot sell the
units unless one of the following four contingencies occur:
1. Markevicius obtains a removal permit from the Rent
Control Board or a court of competent jurisdiction; or
2. Markevicius obtains a vested right determination
from the Rent Control Board or a court of competent
jurisdiction; or
3. Markevicius obtains a final administrative or
judicial determination that no further local approvals are
required; or

4. A final appellate court decision conclusively
resolves the legal issue of the necessity of Markevicius to
obtain any additional local approvals.
The two final subdivision maps have been reviewed and
approved by both the County Engineer and the City Engineer.
The subdivider has paid all fees associated with processing
the final maps.
RECOMMENDATION
It is respectfully recommended that the City Council
approve Final Tract Map Numbers 36639 and 36640 by adopting
the standard resolutions for this purpose.

the City of Santa i4onica b2 and the same hereby accepted and
approved.
SECTIOP! 2. That the City Clerk hereby is authorized
and directed to endorse upon the face of said Map this
order authenticated by the Seat of the City of Santa Monica.
SECTION 3, That the City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect..
