SUBJECT: Approval of Final Tract Map No. 36460, 1743 Ninth
Street, Marshall and Spitzer
On January 20, 1982, the FIonorable Leon Savitch granted
a writ of mandate compelling. the City to approve the filing of
Marshall and Spitzer's final tract map without regard to the
removal permit provisions of the Rent Control Charter Amendment.
Taking action on this final map does not jeopardize the City's
position that the removal permit provisions are dependently
enforceable irrespective of the Subdivision Map Act context.
A Tentative Tract Map for this eight unit condominium
conversion was approved on February 5, 1979. Marshall and
Spitzer have complied with all the requirements set forth in
the tentative map including the installation of garage doors
and trash enclosure. Pursuant to Government Code Section
66458(a), the City Council is obligated to approve the final
map.
Recommendation
It is respectively recommended that the City Council
approve Final Tract Map Number 36460.

AS FOLLOWS:
SECTION 1. That the Map of Tract No. 36460 in
the City of Santa i4onica be and the same hereby accepted ar~d
approved.
SECTION 2. That the City Clerk hereby is authorized
and directed to endorse upon the face of said I~tap this
order authenticated by the Seal of the City of Santa Fion;ca.
SECTION 3. That the City Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect. -
