Subject: Civic Parking Structure Tenant Improvements Project
Recommended Action
Staff recommends that the City Council:
1. Activate phase two of the design-build Contract No. 8960 (CCS) with T.L.D.
Construction, Inc. for construction of the Civic Parking Structure Tenant
Improvements Project;
2. Appropriate funding and approve a Guaranteed Maximum Price (GMP)
Amendment not to exceed $1,850,000 plus a 10% contingency of $185,000, in
the event unforeseen conditions should arise, for a total of $2,035,000;
3. Approve appropriation changes as set forth in the Financial Impacts and Budget
Actions section; and
4. Authorize the Director of Public Works to issue any necessary change orders to
complete additional work within budget authority.
Executive Summary
On July 23,2008, City Council authorized execution of a Design-Build Agreement with
T.L.D. Construction, Inc. to design and construct the Civic Parking Structure Tenant
Improvements Project. The Design-Build Agreement had two phases. Phase one,
preconstruction services includes all the design work necessary to develop a
Guaranteed Maximum Price (GMP). Phase Two is the construction phase based upon
the scope of work covered by the GMP. With Council approval of the proposed GMP,
construction of the Civic Parking Structure Tenant Improvements Project will commence
January 2009 and is anticipated to be completed in May 2009. Funds for this project
are available in the project budget.
Discussion
Completed in 2007, the award-winning 882 space Santa Monica Civic Center Parking
Structure designed by Moore Ruble Yudell incorporates ground floor and plaza level
tenant space envisioned to provide an array of complementary uses to serve the Civic

Center area and create an active and welcoming pedestrian environment. The 3,500
square-foot commercial area along the plaza level on Olympic Drive was designed with
a cafe use in mind, however due to the large size of the space, limited market area, and
lack of tenant improvement contributions offered by the City, staff had difficulty
attracting a food service operator after several releases of a Request for Proposal
On July 8, 2008, City Council endorsed the strategy to address administrative space
needs and directed staff to pursue the development of City office space in addition to a
smaller cafe in the Civic Center Parking Structure. The City Transportation Management.
Division's permit sales counter will, be integrated into this area and will share the space
with a smaller cafe. This joint public-service function will enable the City to incorporate
tenant improvement construction that benefits both the City offices and cafe. Cost for
the tenant improvements are part of the design build agreement approved by Council on
July 23, 2008. The City will build out the restrooms, City offices and common areas.
These improvements will centralize public service and reduce City operating expenses.
Trimana Grill, the approved cafe operator, will pay for, and build out, the area internal to
their operations.
The contract with T.L.D. Construction, Inc. was to provide Phase Ipre-construction
services including completing the design. T.L.D. Construction, Inc. has provided
services that have been professional, reliable, and timely. Moore Ruble Yudell (MRY) .
architects worked with City staff and Trimana Grill on developing the design. The
Guaranteed Maximum Price for Phase Two of the agreement is $1,850,000 for the
construction of the project.
Financial Impacts ~ budget Actions
This project is to be funded with remaining bond proceeds from the 2004 issuance of
lease revenue bonds for the civic center parking project. Council must appropriate funds
in the amount of $2,035,000 for the GMP Amendment to the design-build contract at
Account 0014017.589210 (Civic Center Parking Tenant Improvements- Bond Fund).
