Background
Mr. Schwartz was issued a Building Permit No. B54038
($85,000) 2-6-81 to construct a new duplex on property
at 1239 24th Street with an existing duplex for a total
of 4 units. -This project is now under construction
Ordinance iVo. 1085 CCS (SMMC 7166) was adopted in March
78 and requires-new electric services in Santa Monica
in other than R-1 zones to be underground for aesthetic
reasons. Mr. Schwartz appealed this requirement to the
Electrical Appeals Board; and his case was heard and
denied by unanimous vote 6-4-81. Mr. Schwartz was not
present as he could not be contacted by phone.
Comment & Recommendation
The Electrical Appeals Board has reviewed a number of appeals
on this undergrounding requirement over the past 40 months.
Generally they have denied all requests that were not well
justified by either difficult or extreme site physical
conditions or an applicants temporary circumstances (e.g.
short term lease). Staff recommendation is that the
decision of appeals board in this case for a single under-
ground service be upheld for safety as well as aesthetic
reasons.

Note: A regular Electrical Appeals Board meeting has (j`~
been scheduled for 6:15 PM July 28, 1981 for other y ~
business. Staff is attempting to contact Mr. Schwartz ~ ~j ~~
