SUBJECT: SANTA MONICA BUILDING CODE -- COVERED MALL BUILDING
REGULATIONS
Introduction
This report transmits for introduction and first
reading the attached ordinance which provides for incor-
poration by reference of_ Uniform Building Code Appendix 11
"Covered Mall Buildings" as modified by the Santa Monica
Building and Safety Commission into Section 8103 of ttie Santa
Monica P?unicipal Code.
Background
On P4arch 13, 1978, the Santa Monica Building and
Safety Commission voted to adopt a document entitled Uniform
Building Code Appendix 11"Covered Mall Buildings" with certain
modifications as the appropriate regulation governing design..'
safety standards for covered mall buildings.
On April 25, 1978, the City Council unanimously
approved the recommendation of the Building Safety Commission
and directed that the City Attorney prepare an appropriate
ordinance. The attached ordinance accomplishes the result
desired by the Council and the Commission by adopting the
document approved by the Commission into the Santa Monica

Recommendation
It is respectfully recommended that the City Council

OF THE SANTA P4ONICA MUNICIPAL COllE.
WFIEREAS, Section 8103 of the Santa Monica Municipal
Code adopts certain documents entitled "Uniform Building
Code, 1976 Edition" and "Uniform Building Code Standards,
1976 Edition", adopted by the International Conference of
Business Officials, together with amendments, deletions or
modifications thereto, as the Santa Monica "Building Code";
and
WHEREAS, the Building and Safety Commission of the City
of Santa Monica, on March 13, 1978, approved a document pro-
posed as Appendix Chapter 11 to the 1976 Uniform Building Code,
as modified, as an equivalent design safety standard to the
Uniform Building Code governing covered mall buildings, the
City Council of the City of Santa Monica ordains as follows:
SECTION 1. Section 8103 of the Santa Monica Dunicipal
Code is amended to read as follows:
"Those certain documents entitled
"Uniform Building Code, 1976 Edition,"
and "Uniform Building Code Standards,
1976 Edition," adopted by the Inter-
national Conference of Building

Officials, together with that certain
document entitled "Draft Uniform Build-
ding Code Appendix Chapter 11, Covered
Mall Buildings," as modified by the
Santa Monica Building and Safety Com-
mission on iRarch 13, 1978, .are hereby
adopted as amended, deleted or modified
therein, as the Building Code of the City
of Santa Monica, and shall be referred to,
together with such amendments, deletions
or modifications thereto, as the "Building
Code."
SECTION 2. Any provisions of the Santa Monica Municipal
Code, or appendices thereto inconsistent herewith, to the extent
of such inconsistencies and no further are, hereby repealed
or modified to that extent necessary to effect the provisions
of this ordinance.
SECTION 3. If any section, subsection, sentence,
clause or phrase of this ordinance is for any reason held to
be invalid or unconstitutional by a decision of any court of
competent jurisdiction, such decision shall not affect the
validity of the remaining portions of the ordinance. The
City Council hereby declares that it would have passed this
ordinance and each and every section, subsection, sentence,
clause or phrase not declared invalid or unconstitutional
without regard to whether any portion of the ordinance would
be subsequently declared invalid or unconstitutional.

SECTION 4. The Mayor shall sign and the City Clerk
shall attest to the passage of this ordinance. The City Clerk
shall cause the same to be published once in the official
newspaper within fifteen (15) days after its adoption. The
ordinance shall become effective after thirty (30) days from
its adoption.
