Subject: Ordinance Amending Santa Monica Municipal Code (SMMC) Section
9.04.02.030.305 (Fence Height), Section 9.04.02.030.395 (Hedge), and
Section 9.04.10.02.080 (Fence, Wall, Hedge, Flagpole).
Recommended Action
Staff recommends that the City Council adopt the attached ordinance.
Executive Summary
At its meeting on October 14, 2008, the City Council introduced for first reading an
ordinance modifying fence, wall, and hedge standards; grandparenting existing
nonconforming fence, wall, and hedge that have been properly registered;
clarifying/establishing criteria for the repair .and replacement of registered
nonconforming fences, walls, and hedges; establishing administrative and discretionary
height modification procedures; requiring the maintenance of hedges; and specifying a
self-help remedy for overhanging hedges. The ordinance is now presented to the City
Council for adoption.
