Subject: Construction of the Pier Central Restroom Facility
Recommended Action
Staff recommends that the City Council:
1. activate phase two of the design-build Contract No. 8821 (CCS) with T.L.D.
Construction, Inc. for construction of the Pier Central Restroom Facility;
2. approve a Guaranteed Maximum Price (GMP) Amendment not to exceed
$2,891,060 plus a 10% contingency of $289,106, for a total of $3,180,166;
3. authorize using $990,166 from the Pier Infrastructure- Improvements Project
PhaselVforthisproject; ahd
4. authorize the Director of Public Works to issue any necessary change orders to
complete additional work within budget authority.
Execaative Summary
On September 11, 2007, City Council authorized execution of a Design-Build
Agreement with T.L.D. Construction, Inc. to design and construct the Pier Central
Restroom Facility. The agreement had two phases. Phase one, preconstruction period,
authorized T.L.D. Construction, Inc. to complete design work necessary. to develop a
Guaranteed Maximum Price (GMP) that would be presented as the phase two action for
Council consideration. With Council approval of the proposed GMP, construction of the
Pier Central Restroom Facility will commence September 2008 and will be completed
July 2009. Funds for this project are available in the Pier Fund.
®iscussion
Replacing the Pier's central restroom and providing additional restroom facilities has
been an important goal of the Santa Monica Pier Restoration Corporation (SMPRC) for
many years. In 2004, the SMPRC approved the concept design for the facility and
recommended refinements to the project that included a new storage space for vending
carts, a space for a commissary for food carts, storage for Santa Monica Pier Lessee's
Association furniture, and a retail space adjacent to the Municipal Pier. The project also

includes repair/replacement of wood piles under the eastern portion of the facility; and
provides 32 toilets; 9 urinals, 18 hand wash sinks, a storage area and a 190 sq. ft retail
space. A special whimsical feature that the SMPRC specifically endorsed within the
design was the undulating roof.
Council authorized a contract with T.L.D. Construction, Inc. on September 11, 2007 to
complete the design. T.L.D. Construction, Inc. has provided services -that have been
professional, reliable, and timely. During design, project costs exceeded budget
resulting in the following value engineering adjustments: omission of the food vending
cart commissary space; omission of the storage area for stacking and storing modular
stage system and chairs; changing curved steel beam to curved glue laminated wood
beams; replacing a large sand trap in the sewer line with smaller traps; using less
expensive metal mesh below the curved roof; and using a less expensive porcelain tile.
T.L.D. Construction, Inc. worked on revising the design to reduce project costs and to
develop the adjusted Guaranteed Maximum Price Amendment in the amount of
$2, 891, 060.
While costs have been lowered, there remains a budget shortfall of $990,166, attributed
to inflation in construction costs since the first cost estimate was prepared. One of the
alternatives to resolve the budget shortfall is to redesign the project reducing the scope
of work by eliminating programmatic elements such as the retail kiosk, removing the
privacy screen, reducing number of toilet fixtures and redesigning the roof structure.
However, these adjustments would add a minimum of one year to the project schedule
due to redesign and consequent re-submittals to the various regulatory bodies. Given
the 33-35% annual cost escalation of recent years, the more modest project design a
year from now would probably end up costing the same as this current design, therefore
staff recommends that the project proceed as designed. The project as designed meets
critical needs of the Santa Monica Pier. The design has undergone a thorough process
and is best suited for the Santa Monica Pier. This staff report recommends funding the
shortfall using funds for the Phase IV Pier Infrastructure Improvements Project. The

scope of work for the Phase IV Pier Infrastructure Project will be developed based on
the adjusted budget and if required future funding requests will be processed
Previous Council Action
On February 28, 2006, City Council approved the concept design and on September 11,
2007 City Council awarded design-build Contract No. 8821 (CCS) to T.L.D.
Construction, Inc.
Commission Action
The design was reviewed by the Architectural Review Board on September 18, 2006,
approved by the Landmarks Commission on March 12, -2007 and by the California
Coastal Commission on May 10, 2007. The SMPRC reviewed and approved the
concept design on November 3, 2004 and approved design development drawings on
May 7, 2008.
