Swain, Director -Department of Public Works Subject: Public Hearing arid Resolution Ordering Vacation of Excess Public Right- of-Way along High Place Recommended Action Staff recommends that the City Council: 1. hold a public hearing to receive comments regarding the proposed vacation of excess public right-of-way along High Place; and 2. adopt the attached resolution ordering the vacation. Executive Summary Community Corporation of Santa Monica will develop a .project that includes two components. A 45-unit condominium development will be located on High Place East and a 47-unit rental housing will be located on_High Place West. The project relies on a vacation of excess right-of-way along High Place which will. be incorporated into the project. The project will relocate a public alley and utilities to the western portion of the project site. Background California law authorizes vacating a public street or service easement, after notice and a hearing, based on the finding that the property- is unnecessary for present or prospective public use (Streets & Highways Code section 8324). On December 12. 2007, the Planning Commission approved the Project's Environmental Impact Report, Development Review Permit, Vesting Tentative Tract Map No. 67428, and Statement of Official Action. City Council approval is required for 1 the vacation of the excess public right-of-way along High Place and dedication of a new public alley, and the Final Map. The Final Map will be presented for City Council's consideration at a future date At its July 23. 2008 meeting, the City Council directed the City Clerk to set a public hearing on the proposed vacation proceedings for September 9, 2008 at 5:45 p.m. Notice of the date, hour and place of the public hearing was published on August 19, August 26, and September 2 in the Santa Monica Daily Press. Notices noting the time and place of the public hearing were posted along the area of the proposed vacation. Publication and posting of the notices was done in accordance with Part 3, Chapter 3 of the California Streets and Highways Code, "General Vacation Procedures". Discussion High Place is a cul-de-sac that extends north from Virginia Avenue and runs through the middle of the project site and connects to an alley that provides vehicular access to the parking areas of adjacent properties to the west. A portion of High Place, as depicted in the drawing attached to the Resolution as Exhibit "A", is proposed to be vacated and its area incorporated into the project site. The project proposes to dedicate a new 22-foot wide public alley that would run along the western border of the site to Virginia Avenue. Existing utilities that underlie the right-of-way will be re-routed.. An existing six-inch water main located under High Place will be removed and a new water main installed in the proposed new public alley. The existing sewer line under High Place, which serves parcels within the project site, will be abandoned, and the project will connect to the sewer system via an existing sewer main adjacent to the northern site boundary. Access to the project site will be provided from Virginia Avenue via the new public alley. Financial Impacts. & Budget Actions There is no impact on the City's budget as a result of the proposed High Place vacation. All costs associated with the construction of public improvements and relocation of City- -2- owned utilities and non-City-owned facilities, such as power, gas and telecommunication lines in the right-of-way will be borne by the Developer.
