Subject: Design Build Contract for the Civic Parking Structure Tenant
Improvements Project.
Recommended Action
Staff recommends that the City Council authorize the City Manager to negotiate and
execute adesign-build contract for preconstruction services with TLD Construction, Inc.
for the Civic Parking Structure Tenant Improvements project, in an amount not to
exceed $270,000, including contingencies.
Executive Summary
The recently completed Santa Monica Civic Parking Structure has been successfully
meeting the parking needs in the Civic Center. The tenant spaces on the ground and
second levels have not generated interest from the business community and remain
vacant. The improvements contemplated include tenant spaces to house Building and
Safety staff in Code Compliance, Inspection and- Plan Check; apublic-serving City
office; a cafe space; and restroom facilities. These improvements will centralize public
service and reduce City operating expenses. Funds for this project are available in the
Civic Center Parking Structure construction account.
Background
The recently completed Santa Monica Civic Parking Structure has earned international
recognition for architectural features including colored glass fagades, photovoltaic
panels on roof, and for being the first parking structure to have earned LEED
certification, an award for sustainable buildings. The Civic Parking Structure was also
recently awarded the Los Angeles American Institute of Architects Honors award for
design.

While Civic Center parking needs have been met, the business community has not
expressed interest in leasing the vacant tenant spaces because of insufficient
pedestrian foot traffic along 4ih Street. .Also, restaurant operators have indicated that
the restaurant space is too large. The vacant tenant spaces offer an opportunity to
house City services that will result in reduced City operating expenses and centralized
public services for convenience to the public. Furthermore, a smaller cafe space will be
more marketable and more likely to secure a restaurant operator.
The Building and Safety Code Enforcement Unit is currently occupying leased private
office space located at 525 Broadway. However, the lease is scheduled to expire spring
2009 and the Code Enforcement Unit needs to be relocated.. Building and Safety Plan
Reviewers are temporarily working in the City Hall roof top mezzanine spaces that are
physically difficult to reach, and lack sufficient space, lighting and ventilation.
The proposed tenant improvements are consistent with the short term City office space
goal of centralizing City services in the Civic Center for added public convenience, and
will save the monthly expense of leasing private office space. The tenant improvements
will house Building and Safety staff in Code Compliance, Inspection and Plan Check
along the 4th street tenant spaces. The north side plaza level spaces are envisioned to
house apublic-serving City office, a reduced size cafe space, and a restroom facility.
that will serve tenants and customers using the parking structure. The adjacency of the
public-serving City office counter and the cafe/food service counter will also result in a
new. and positive experience for visitors to the Civic Center. Several restaurant
operators have already expressed interest in the smaller space and are currently in
negotiations with Housing and Economic Development Department staff to lease and
operate the cafe space.

Discussion
A Notice Inviting Bids for design-build services was published on April 9 and 10, 2008 in
the Santa Monica Daily Press and the Los Angeles Times. The scope of work
contained in the Notice Inviting Bids required that each bid include an integrated team of
architects, engineers and construction general contractors. The City received four bids.
A Selection Committee composed of staff from Environmental and Public Works
Management, Planning and Community Development as well as Housing and Economic
Development Departments reviewed the bids and interviewed the firms. The Selection
Committee recommends TLD Construction, Inc. as the most responsive bidder. MRY
Architects will be the design subconsultant. Both firms have completed a variety of
projects of greater magnitude involving tenant improvements.
MRY is the original designer for the Santa Monica Civic Parking Structure and is more
capable of resolving inherent design challenges. Furthermore, MRY should provide an
aesthetic cohesiveness between the exterior .architecture and the interior tenant
improvement spaces. MRY is an internationally recognized architectural firm. who also
designed the Santa Monica Main Library, as well as numerous tenant improvement
projects including restaurant spaces.
TLD Construction successfully completed the Santa Monica Big Blue Bus Transit Store
at 223 Broadway, City of Burbank Children's Center and the Sierra Madre Youth Activity
Center. The team also includes structural, civil, mechanical and electrical engineers.
References supplied were contacted and indicated that the services performed by the
proposal team were professional, within budget and .timely. Of the qualified bidders,
TLD Construction, Inc. had the lowest bid. The proposed contract amount includes the
design builder's pre-construction services and all design fees through completion of the
bid documents and development of a guaranteed maximum price.

Next Steps
Staff will return to Council in fall 2008 at the completion of the design development
phase for approval of the proposed guaranteed maximum price. and activation of the
second phase of the design-build contract. Construction is expected to begin spring
2009.
Financial Impacts & Budget Actions
Funds for this contract in the amount of $270,000 are available in account
0010562.589001 "Civic Parking Structure Tenant Improvements". Upon relocation into
the Civic Center Parking Structure tenant space, Building and Safety Division budget
will be adjusted to reflect the ongoing annual rental savings of approximately $110,400.
