Subject: .Public Hearing for the Formation of a Property Based Assessment District
(PBAD) in Downtown Santa Monica
Recommended Action
Staff recommends that the City Council hold a public hearing and receive comment
regarding the formation of a Property Based Assessment District (PBAD) in downtown
Santa Monica.
Executive Summary
On May 13, 2008, City Council accepted petitions from properly owners representing
more than 40% of the proposed assessments and approved Resolution No. 10285
(CCS) declaring its intention to set a public hearing for tonight, July 8, 2008, to consider
the formation pf a property based assessment district, and authorize the mailing of
ballots to property owners. Ballots are accepted until the -close of tonight's public
hearing and will be tabulated and certified by the Office of the City Clerk. Results will be
announced at the following Council meeting on July 22, 2008, and Council will be asked
to take action subject to the ballot results.
Background
In accordance with state law establishing property-based assessment districts, a ballot
has been sent to all property owners within the boundaries of the proposed assessment
district along with the proposed assessment amount for each individual property. Ballots
are accepted until the close of tonight's public hearing and will be tabulated and certified
by the Office of the City Clerk. Ballots will be counted and weighted according to the
proportional financial. obligations of the assessed property. Results will be announced at
the Council meeting on July 22, 2008.
If the election results in a majority favoring the formation of the assessment district,
Council will consider a Resolution approving the levying of assessments and the

Engineer's Report. The City will submit the assessment rolls to the County Tax
Assessors for collection for the next tax cycle.
Also, on July 22, 2008, Council will be asked to amend the Services Agreement
between the City ahd the Bayside District Corporation regarding indemnification by
Bayside of the City. Other issues to be negotiated, including basic and enhanced
maintenance services, the role of ambassadors, etc., will also be detailed at that time so
that Council can give staff direction about how these and other issues should be
addressed in a subsequent agreement.
Previous Council Action
Council reviewed and provided direction on the development of the Management Plan
at its meetings on April 24, 2007, January 22, 2008 (study session); and March 25.
2008. On Mav 13, 2007, City Council accepted petitions from property owners
representing more than 40% of the proposed assessments and approved Resolution of
Intention No. 10285 (CCS) declaring its intention to set this public hearing.
Financial Impacts & Budget Actions
Should the ballot measure pass with a majority of respondents and Council approves
the formation of the proposed PBAD, City-owned properties would be .assessed
$74,232 and Redevelopment Agency-owned properties would be assessed $257,099.
