SUBJECT: REFERRAL TO PLANNING COMMISSION OF DRO83, P1i-T-MART,
3102 MAIN STREET FOR CONSIDERATION OF CHANGE OF CONDITIONS
Introduction
This memo transmits the request of Michael Toumajian for consideration
of a change in the conditions imposed by the City Council in granting
an interim development premit for a Mi-T-Mart at 3102 Main Street and
recommends that it be returned to the Planning Commission for determin-
ation.
Background
The City Council, on appeal from the Planning Commission's approval of
this project, granted an interim development permit with conditions
on July 27, 1982. The applicant Michael Toumajian has requested
modification. of the conditions limiting the hours of operation to
6 a.m. to 12 midnight and prohibiting the sale of alcoholic beverages.
Through his attorney, Mr. Toumajian has offered to alter his development
proposal in order to eliminate the potential for problems which led to
imposition of those conditions.
Sebsequent to the July 27, 1982 City Council hearing, the Alcoholic
Beverage Control Board approved the issuance of an off-sale license
on condition that there be no wine selling for less than $2.00 per
750 m7.. bottle. Mr. Toumajian has agreed to this condition. The

applicant is working with the Police Department to develop a security
plan which. meets the concerns of the Police Chief.
The Planning Commission is familiar with this project .and can
ascertain that the concerns o£ the Planning Commissioners and the
City Council are met by the modifications proposed by the applicant.
Recommendation
It is respectfully recommended that the City Council refer this pro-
ject to the Planning Commission with authority to determine whether
conditions of the Interim Development Permit should be modified.
The decision of the Planning Commission will be final unless appealed
to the City Council in accordance with procedures for appeal of interim
development permits.
