SUBJECT: Appeal, Interim Development Permit No. DR 039, New
6 Unit Condominium, 933 Ninth Street, R3, Beroukhim,
Nosratian and Sabar.
Introduction
This is an appeal from the Planning Commission's determination
in the matter of an Interim Development Permit for a new 6 unit
condominium project at 933 DTinth Street. Appeal is by Council-
person Dennis Zane.
Background
In 1980 the applicants received tentative approval for a 6 unit
condominium and also a Final Map in February 198?.. Inasmuch as
the original design was for a 3 story, 6 unit building with 50%
lot coverage on an R3 lot it meets the new standards proposed by
Resolution 6385. An application for an Interim Development Permit
to begin construction was approved by the Planning Commission
but a proposed requirement that the applicant agree to comply
with all requirements of the new Housing Element in effect at the
time of a certificate of occupancy is issued was not included.
This decision was appealed by Councilmember Zane.
Alternatives
Under Ordinance No. 1220 the City Council may affirm, reverse
or modify any determination of the Plannina Commission in regard
to an Interim Development Permit.

Recommendation
It is respectfully recommended that the interim development permit
be denied without prejudice at this time. Upon the adoption of a
housing element, the matter will be rescheduled before the Planning
Commission without the need to file a new application.
