SR-052378-6PT0: Mayor and City Council MAY 2 3 1978 FROM: City Staff ~, ., SUBJECT: Authorization to Execute Quit Claim Deed - Kinney Street Ocean Park Redevelopment Project ,, ' " _. ~ Background When the City vacated portions of Kinney Street, Pier Avenue and Marine Place in 1965 in conjunction with the Ocean Park Project, they retained certain utility easements. Subsequently, as the development plans were finalized, the City quit claimed those retained easements with respect to Pier Avenue and Marine Place in 1973• Discussion Now that the Lincoln Property Company's site plan has been finalized, the utility easements in Kinney Street are not appropriate and in fact unnecessarily compli- cates the title policy for the parcels to be sold to the Lincoln Property Company. Consequently, it is recommended that the City quit claim its utility easements in the vacated portion of Kinney Street. Recommendation It is recommended that the Council authorize the City Manager to execute, and the City Clerk to attest to, the attached Quit Claim Deed with respect to the utility easements in the vacated portion of Kinney Street. C. $6103 DOCUMENTARY TRANSFER TAX.- NONE (Signature) QUITCLAIM DEED (Kinney Street) In its 'resolution vacating a portion of Kinney Street, the City of Santa Monica reserved certain easements over the vacated street. The vacation and reservation was set out in Resolution No. 3281 (City Council Series), a copy of which was recorded on June 15, 1965 in the Los Angeles County Recorder's office as Instrument X3578. THE CITY OF SANTA MONICA, a municipal corporation, hereby quitclaims to the REDEVELOPMENT AGENCY OF TFiE CITY OF SANTA MONICA, a public body corporate, all of its right, title and interest in and to all of the reserved and excepted easements in said Resolution No. 3281 as it affects Kinney Street as described therein.
