Subject: Re-hearing of Appeal APP06-039 of Landmarks Commission Designation
of the Property at 2219 Ocean Avenue as a City Landmark.
Recommended Action
Staff recommends that the City Council re-hear the appeal.
Executive Summary and Discussion
The City Council originally heard this item on June 26, 2007, which resulted in a
technical denial because a majority of the City Council did not vote to reverse or modify
the Landmark Commission's decision. As a result, the Landmarks Commission's
decision to designate the subject property as Landmark was upheld. Subsequent to the
hearing, the appellant's attorney submitted a letter on July 17, 2007 challenging the
handling of the Foundation's appeal and threatening litigation against the City.
As a result of the threatened litigation, the City entered into a settlement agreement with
the appellant and agreed to re-hear the appeal and include all public testimony and
written submissions from the June 26, 2007 City Council hearing.
