SUBJECT: Public Hearing to Vacate a Portion of Seventh Court from
Broadway to 250 Feet .Southeasterly of Broadway
Introduction
This report recommends that the City Council hold a public hearing
to vacate the portion of Seventh Court that runs from Broadway to
approximately 250 feet southeasterly of Broadway. A condition of
vacation of this alley portion is the dedication of an easement for
utilities and new alley access to route traffic from Seventh Street
to Seventh Court.
Background
Von's Companies, Inc., is proposing to construct a new supermarket
on the south side of Broadway between Seventh Street and Lincoln
Boulevard. Improvements to traffic circulation for the new
development requires the vacation of Seventh Court from Broadway to
approximately 250 feet south of Broadway. Von's owns lots east and
west of Seventh Court and proposes to build a supermarket on the
west side of the alley and a parking lot on the east side. In
consideration for the City vacating this alley, Von's will dedicate
a 20-foot wide public right-of-way easement for utilities and
vehicular access from Seventh Street to Seventh Court and an

easement over the length of the vacated alley for utility services.
Von's will also underground the overhead power line within the
development area per City requirements and construct a new alley in
concrete. The attached map contains the details of this proposal.
It is customary to vacate an alley or portion thereof when property
owners on both. sides agree and when the alley is not required for
the movement of traffic, refuse service, emergency fire access, or
other public needs. In this case, the same owner owns both sides.
The Director of General Services, the City Engineer, the City
Parking and Traffic Engineer, the Commander of Operations in the
Police Department and the Battalion Chief for Fire Prevention in
the Fire Department have reviewed the plans and all concur that the
vacation is appropriate since the new alley will improve public
access to the supermarket and facilitate traffic circulation and
safety in the area.
Budaet/Financial Impact
There is no impact on the City's budget as a result of the partial
vacation of Seventh Court

Recommendations
It is recommended that the City Council:
1. Open the public hearing;
2. Close the public hearing and acknowledge any protests; and
3. Adopt the attached resolution ordering the vacation of a
portion of Seventh Court from Broadway to 250 feet
southeasterly of Broadway.

At a regular meeting held on September 28, 1993, the City Council
of the City of Santa Monica adopted Resolution No. 8663 (CCS) which
proposes the vacation of Seventh Court between Broadway and 250
feet southeasterly of Broadway, and the dedication of a 20-foot
right-of-way access from Seventh Street to Seventh Court.
The City Council will hear and pass upon objections or protests to
the. vacation, if any, by the property owner or other interested.

I would like to express several concerns I have regarding the
proposed Vons market project at Seventh Street and Broadway in
Santa Monica.

I foresee several problems with the kiosks that are planned
for the side of the market facing Broadway and .the rear of the
market facing Seventh Street. The kiosks at the rear facing
Seventh Street do not appear to be economically viable, due
to the fact that there is very little foot traffic on Seventh
Street. In addition, the type of businesses envisioned for
these kiosks are in direct competition with services already
provided by Vons, such as flowers and magazines. It is difficult
to understand how these businesses will flourish and not deteriorate
into ill-kept eyesores.
If kiosks are the only alternative available for the rear wall of
the building, I believe that the sidewalks all around the building
should be refurbished-using bricks or paving stones to welcome
and encourage pedestrians to continue around the building. In
addition, I recommend 24-hour continuous foot patrol by a
security guard on all sides of the market.
Regarding vacation of the alley by the market, the present plans
call for re-routing the alley to enter on Seventh Street, connect
with the existing alley and continue down to Colorado. The Vons
loading docks presumably will be on the south side of the building
next to the new alley entrance. Trucks will unload thercand then
exit down Seventh Court to Colorado. It will be dangerous and
difficult for these trucks to .turn left onto Colorado from the
alley in order to return to Lincoln Boulevard. It would be far
safer for the new alley extension to continue east and connect
directly with Lincoln Boulevard, allowing the semi-trucks and
~~ other delivery vehicles to exit directly onto Lincoln Boulevard.

The alley itself, already in poor physical condition, will
doubtless become much worse. The Vons management company
has told me that Vons will only be required to pour new
concrete in the alley up to 1557 Seventh Street, rather than
the whole length of Seventh Court as originally planned.
With additiional heavy truck and car usage on Seventh Court,
a complete concrete alley will in fact be necessary all.

The Vons Companies, Inc. would like to express its support for the alley vacation, as
recommended by staff, beginning at Broadway and extending approximately 250 feet south.
We would also like the City Council to know that, although it is not a part of the vacation
process, Vons is also workmg with the community to make sure the transition to a new
supermarket will benefit adjacent residents and business owners. Several community members
have contacted Vons and/or its representatives, Morey/Seymour & Associates to discuss design
and other aspects of the project. These community members have included Eri Kroch, Gregory
Sackler, Larry Beaufait, Frank Dorset and Earl Shor. Topics of discussion have included site
security, landscaping, and building detailing. We believe these talks have been very beneficial
to both parties and have resulted in a better understanding of the overall project.
The Vons Companies, Inc. would like to state that in the interest of a hazmonious and healthy
community, any site questions or concerns will continue to be addressed by Vons staff and their
representatives as well as the appropriate Santa Monica agency. In addition, the Architectural
Review Board public heazing will provide yet another forum for community input.
We believe this information is important since the public hearing tonight is strictly relating to
the vacation of the ally and the dedication of a permanent public easement.
